(4) ยอดใช้จ่ายสะสมผ่านบัตรหลักไม่นับรวม รายการยอดถอนหรือบริการเงินสดผ่านทุกช่องทาง, ยอดใช้จ่ายหมวดกองทุนรวมทุกประเภทและยูนิตลิงค์ (UNIT LINK), การซื้อหน่วยลงทุนต่างๆ, การทำธุรกรรมเกี่ยวกับสินทรัพย์ดิจิทัล (Digital Asset) และคริปโทเคอร์เรนซี (Cryptocurrency) รวมถึงโบรคเกอร์ซื้อขายหุ้นต่างๆ, ดอกเบี้ย, ค่าธรรมเนียมต่างๆ, ค่าปรับ, รายการใช้จ่ายที่ยกเลิกหรือยอดค่าใช้จ่ายที่มีการคืนสินค้าในภายหลัง, ยอดใช้จ่ายที่เอื้อผลประโยชน์ทางธุรกิจและ/หรือผลประโยชน์ส่วนตัวแก่ผู้ถือบัตรโดยทางตรงและทางอ้อมในเชิงพาณิชย์หรือเพื่อให้ได้รับสิทธิประโยชน์จากรายการส่งเสริมการขาย, การใช้จ่ายที่ไม่เป็นไปตามเงื่อนไขใช้บัตรเครดิตหรือการกระทำใดที่ผิดกฎหมาย, รายการที่ใช้จ่ายผ่านเครื่องรับบัตรเครดิต (EDC) ในกิจการของผู้ถือบัตรเอง หรือมีส่วนเกี่ยวข้องกับเจ้าของกิจการ
(5) สงวนสิทธิ์การรับของสมนาคุณ 1 ชิ้นต่อลูกค้า 1 ท่านตลอดรายการ
(6) รายการส่งเสริมการขายนี้ไม่สามารถใช้ร่วมกับรายการส่งเสริมการขายอื่นๆ ได้
(7) ของสมนาคุณไม่สามารถแลก, เปลี่ยน, ทอน หรือคืนเป็นเงินสดได้
(8) บริษัทฯ จะจัดส่งของสมนาคุณแก่ท่านสมาชิกตามที่อยู่ในใบแจ้งยอดบัญชี ดังนี้

(9) บริษัทฯ สงวนสิทธิ์ส่งของสมนาคุณให้เฉพาะผู้ที่ยังคงสภาพการเป็นสมาชิก ไม่ผิดนัดชำระหรือปฏิบัติผิดข้อกำหนดใดๆ และรับใบแจ้งยอดบัญชีอิเล็กทรอนิกส์ (E-STATEMENT) รวมถึงปฏิบัติตามเงื่อนไขอื่นๆ ที่ระบุไว้ในเงื่อนไขโปรโมชันตลอดระยะเวลารายการส่งเสริมการขายนี้ จนถึงวันที่บริษัทฯ มอบของสมนาคุณให้ท่าน และสงวนสิทธิ์เรียกคืนมูลค่าของสมนาคุณหากมีการยกเลิกรายการใช้จ่ายในภายหลัง โดยยึดถือข้อมูลที่ปรากฎในระบบของบริษัทฯ เป็นสำคัญ กรุณาเก็บหลักฐานการเข้าร่วมรายการ และเซลล์สลิปไว้ตรวจสอบกรณีจำเป็น
(10) บริษัทฯ จะงด/ระงับการให้สิทธิประโยชน์ หรือเรียกคืนสิทธิประโยชน์ (รวมทั้งคะแนนสะสม) หรือเรียกเก็บเงินจากบัญชีบัตรเครดิตของสมาชิกบัตรตามมูลค่าของสิทธิประโยชน์ที่สมาชิกบัตรได้รับ ในกรณีที่มีการให้สิทธิประโยชน์ไปโดยผิดหลง หรือกรณีที่สมาชิกบัตรยกเลิก/ปฏิเสธรายการหรือการชำระเงินในภายหลัง (แบบเต็มจำนวนทั้งหมดและบางส่วน) หรือกรณีที่ยอดใช้จ่ายเกิดจากการใช้วงเงินที่ชำระไว้เกิน หรือวงเงินชั่วคราว หรือกรณีมีการใช้สิทธิเข้าร่วมรายการโดยไม่สุจริต ทุจริต ฉ้อฉลเพื่อให้ได้มาซึ่งสิทธิประโยชน์ หรือกรณีใช้บัตรเครดิตเพื่อผลประโยชน์ทางการค้า/หรือใช้บัตรเครดิตซื้อสินค้า/บริการของร้านค้าซึ่งสมาชิกผู้ถือบัตรมีส่วนได้เสียทั้งทางตรงและทางอ้อมหรือใช้บัตรผิดวัตถุประสงค์ของการใช้บัตรเครดิตเพื่อซื้อสินค้า/บริการหรือไม่เป็นไปตามสัญญาบัตรเครดิตหรือสัญญาสินเชื่อส่วนบุคคล (แล้วแต่กรณี) หรือการทำธุรกรรมเกี่ยวกับสินทรัพย์ดิจิทัล (Digital Asset) หรือคริปโทเคอร์เรนซี (Cryptocurrency)
(11) เงื่อนไขรายการส่งเสริมการขายเป็นไปตามที่บริษัทฯ กำหนด (12) ให้บริการสินเชื่อโดย บริษัท บัตรกรุงศรีอยุธยา จำกัด

Spending in Foreign Currency
The Cardholder agrees and accepts that any transaction made under the Card (including, but not limited to, a cash withdrawal) in any foreign currency shall be charged to the Cardholder in Thai Baht at the exchange rate being charged to the Company by the relevant credit card company as of the date on which such amount is charged to the Company. If the transaction amount is not in the US Dollar currency, such amount shall be converted into the US Dollar before converting into Thai Baht.

In addition, the Cardholder agrees and accepts that the hedging premium at the rate not exceed 2.5% of the spending amount in foreign currency shall be charged by the Company to protect for the risk incurred from such currency conversion.

สัญญาการใช้บัตรเครดิต

ในสัญญานี้หากไม่กำหนดไว้โดยเฉพาะเป็นอย่างอื่นแล้ว
“บริษัท” หมายถึง บริษัท บัตรกรุงศรีอยุธยา จำกัด
“บัตร” หมายถึง บัตรเครดิตที่บริษัทออกให้แก่ผู้ถือบัตร (บัตรหลัก) และให้แก่บุคคลตามที่ผู้ถือบัตรหลักร้องขอ (บัตรเสริม)
“ผู้ถือบัตร” หมายถึง ผู้ที่บริษัทได้อนุมัติให้เป็นสมาชิกของบริษัทเพื่อใช้บริการบัตรเครดิตและส่งมอบบัตรเครดิตให้ใช้ในฐานะผู้ถือบัตรหลัก และ/หรือผู้ถือบัตรเสริม

ก่อนการเปิดใช้บริการบัตร การลงลายมือชื่อหลังบัตร และ/หรือการใช้บัตรนี้ ผู้ถือบัตรกรุณาอ่านข้อกำหนดและเงื่อนไขต่าง ๆ ตามสัญญานี้ให้เข้าใจเพราะโดยการลงลายมือชื่อหลังบัตร การเปิดใช้บริการบัตรและ/หรือการใช้บัตรนี้ของผู้ถือบัตรจะถือว่าผู้ถือบัตรตกลงยินยอมผูกพัน และปฏิบัติตามเงื่อนไขและข้อกำหนดในสัญญานี้ทุกประการ

1. สิทธิหน้าที่ของผู้ถือบัตร
1. 1.1 บัตรที่บริษัทออกให้ถือเป็นกรรมสิทธิ์ของบริษัทซึ่งมอบให้ผู้ถือบัตรเป็นผู้ใช้เท่านั้น ผู้ถือบัตรจะไม่จำหน่ายหรือโอนสิทธิ์ตามสัญญานี้ให้แก่บุคคลอื่นใด รวมทั้งไม่อนุญาตให้บุคคลอื่นใดใช้บัตรแทน และ/หรือลงลายมือชื่อแทนในทุกกรณี ทั้งนี้ ผู้ถือบัตรจะต้องลงลายมือชื่อในช่องที่กำหนดไว้ด้านหลังบัตรทันทีที่ได้รับบัตร โดยการลงลายมือชื่อหลังบัตรและ/หรือการเปิดใช้บัตรนี้จะถือว่าผู้ถือบัตรตกลงยินยอมผูกพันและปฏิบัติ ตามข้อสัญญาต่าง ๆในสัญญานี้ทุกประการ
2. 1.2 ผู้ถือบัตรสามารถใช้บัตรนี้ในการ (ก) เบิกถอนเงินสดล่วงหน้า (ข) ชำระค่าสินค้า ค่าบริการต่าง ๆ และ/หรือค่าอื่นใดแทนการชำระเงินสดไม่ว่าจะผ่านทางร้านค้าหรือสถานที่ให้บริการที่มีเครื่องหมายสัญลักษณ์บัตรติดตั้งอยู่ หรือ (ค) ทำธุรกรรมต่าง ๆ ผ่านช่องทางต่าง ๆ เช่น ทางเว็บไซต์ แอปพลิเคชัน โปรแกรมออนไลน์ที่จัดให้มีโดยบริษัท (“โปรแกรม”) ทางโทรศัพท์ ทางไปรษณีย์ หรือทางเครื่องเบิกถอนเงินสดอัตโนมัติ หรือช่องทางอื่นใดตามที่บริษัทจัดให้มีขึ้น ภายในวงเงินที่ได้รับอนุมัติจากบริษัทหรือในวงเงินที่ผู้ถือบัตรได้ใช้ไปจริง ทั้งนี้ บริษัทสงวนสิทธิ์ที่จะไม่อนุมัติและ/หรือไม่รับผิดชอบวงเงินจากการใช้บัตรที่เป็นการฝ่าฝืนวัตถุประสงค์การใช้บัตร หรือเป็นการ ฝ่าฝืนตามข้อ 2.1 โดยการทำธุรกรรมต่าง ๆ ดังกล่าว (รวมถึงการใช้บริการหักชำระค่าสินค้าและบริการโดยอัตโนมัติผ่านบัญชีบัตรของผู้ถือบัตร เช่น ค่าสาธารณูปโภค ค่าเบี้ยประกันภัย ค่าสินค้าและค่าบริการต่าง ๆ) ผู้ถือบัตรตกลงให้ข้อสัญญาใด ๆ ที่เกี่ยวข้องกับการทำธุรกรรมต่าง ๆ ดังกล่าว (ถ้ามี) ไม่ว่าจะดำเนินการผ่านช่องทางหรือวิธีการใด ๆ ถือเป็นส่วนหนึ่งของสัญญาฉบับนี้ และตกลงยอมรับในข้อกำหนดและเงื่อนไขต่าง ๆ ที่ระบุในสัญญาดังกล่าวทุกประการ
3. 1.3 ในกรณีที่ผู้ถือบัตรใช้บัตรแทนการชำระเงินเกินกว่าวงเงินถาวรที่บริษัทกำหนดโดยได้รับอนุมัติจากบริษัทเป็นครั้งคราว (วงเงินชั่วคราว) ไม่ถือว่าการอนุมัตินั้นเป็นการเพิ่มวงเงินถาวรให้ผู้ถือบัตร และผู้ถือบัตรต้องชำระส่วนที่เกินวงเงินที่ได้ใช้ไปให้กับบริษัทตามเงื่อนไขที่บริษัทกำหนด ทั้งนี้ไม่ว่ากรณีใด ๆก็ตาม หากผู้ถือบัตรได้ใช้บัตรเกินไปกว่าวงเงินที่ได้รับอนุมัติ ผู้ถือบัตรยังคงต้องรับผิดชอบเต็มจำนวน
4. 1.4 ในกรณีที่บริษัทอนุมัติออกบัตรเสริมให้แก่ผู้ถือบัตรเสริมตามคำร้องขอของผู้ถือบัตรหลักแล้ว ผู้ถือบัตรหลักตกลงรับผิดชอบค่าใช้จ่ายต่าง ๆ (รวมถึงแต่ไม่จำกัดเพียงดอกเบี้ย เบี้ยปรับและค่าธรรมเนียมต่าง ๆ) ที่เกิดขึ้นหรือเป็นผลมาจากการที่บริษัทออกบัตรให้แก่ผู้ถือบัตรเสริมและ/หรือการใช้บัตรของผู้ถือบัตรเสริมตามที่ผู้ถือบัตรหลักร้องขอโดยไม่คำนึงถึงข้อจำกัดเรื่องความสามารถทางกฎหมายของผู้ถือบัตรเสริม และจะไม่ยกข้อจำกัดดังกล่าวขึ้นเป็นข้อต่อสู้เพื่อปฏิเสธความรับผิดดังกล่าว หรือเป็นข้อโต้แย้งสิทธิ์ของบริษัทในการเรียกเก็บค่าใช้จ่ายเช่นว่านั้นทั้งหมดจากผู้ถือบัตรหลัก และผู้ถือบัตรหลักตกลงว่าการใช้บัตรของผู้ถือบัตรเสริมเป็นการกระทำภายใต้อำนาจของผู้ถือบัตรหลักทุกประการโดยผู้ถือบัตรหลักจะไม่ปฏิเสธความรับผิดใด ๆ ที่เกิดจากการใช้บัตรของผู้ถือบัตรเสริมไม่ว่าในกรณีใด ๆ ก็ตาม นอกจากนี้ผู้ถือบัตรเสริมตกลงรับผิดร่วมกันกับผู้ถือบัตรหลักในฐานะลูกหนี้ร่วมเพื่อชำระเงินค่าสินค้าและ/หรือบริการอันเกิดจากการใช้บัตรเสริมในส่วนของตน รวมทั้งดอกเบี้ย เบี้ยปรับ และค่าธรรมเนียมต่าง ๆ ให้แก่บริษัท ทั้งนี้ ในกรณีที่บริษัทติดตามหนี้จากผู้ถือบัตรหลักหรือผู้ถือบัตรเสริมรายใดรายหนึ่ง ไม่ถือเป็นการตัดสิทธิ์บริษัทในการติดตามหนี้จากผู้ถือบัตรที่เหลือซึ่งยังคงมีภาระหนี้อยู่ จนกว่าบริษัทจะได้รับชำระหนี้ครบถ้วนหมดสิ้นแล้วทั้งจำนวน
5. 1.5
  ผู้ถือบัตรสามารถใช้บัตรนี้เบิกถอนเงินสดโดยวิธี (1) ทำธุรกรรมผ่านระบบโทรศัพท์อัตโนมัติ หรือเว็บไซต์ หรือแอปพลิเคชัน หรือโปรแกรมของบริษัท หรือผ่านทางโปรแกรมออนไลน์ที่จัดให้มีโดยบริษัท ตามหลักเกณฑ์ในข้อ 5 และข้อ 7 ของสัญญานี้ (2) เบิกถอนผ่านเครือข่ายของ VISA/MASTERCARD/JCB โดยการเบิกถอนเงินสด ณ เคาน์เตอร์ที่มีเครื่องหมาย VISA/MASTERCARD/JCB และ/หรือ (3) เบิกถอนจากเครื่องฝากถอนเงินอัตโนมัติ (ATM) หรือ เครื่องอิเล็กทรอนิกส์ของสถาบันการเงินที่มีเครื่องหมาย VISA/PLUS/MASTERCARD/CIRRUS/ATM POOL/JCB หรือจากเครื่องฝากถอนอัตโนมัติที่บริษัทจัดเตรียมไว้ ตามหลักเกณฑ์ในข้อ 6 ของสัญญานี้ โดย
  1. (ก)ผู้ถือบัตรตกลงปฏิบัติตามสัญญาฉบับนี้และยอมรับการเปลี่ยนแปลงข้อกำหนดใด ๆ ที่อาจมีขึ้นเป็นครั้งคราว
  2. (ข)สำหรับกรณีการทำธุรกรรมผ่านระบบโทรศัพท์หรือทางเครื่องฝากถอนอัตโนมัติ หรือช่องทางอื่นใด ผู้ถือบัตรสามารถกำหนดรหัสประจำตัว (Personal Identification Number หรือ PIN) ด้วยตนเองตามวิธิการที่บริษัทกำหนด หรือที่บริษัทจัดส่งให้กับผู้ถือบัตรตามที่ผู้ถือบัตรร้องขอ (ซึ่งผู้ถือบัตรสามารถเปลี่ยนแปลงรหัสดังกล่าวได้) หรือที่ผู้ถือบัตรลงทะเบียนได้มา หรือด้วยวิธีการทางอิเล็กทรอนิกส์ใด ๆ ตามกฎหมายว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ เพื่อใช้ยืนยันตัวตนในการเบิกถอนเงินสดล่วงหน้าโดยอยู่ภายใต้ข้อจำกัดของจำนวนเงินและจำนวนครั้งที่เบิกถอน ทั้งนี้ ผู้ถือบัตรต้องระมัดระวังป้องกันมิให้ผู้อื่นทราบ หรือล่วงรู้เลขรหัสประจำตัวได้
  3. (ค)ในการเบิก ถอนเงินสดไม่ว่า โดยวิธิหนึ่งวิธีใดตาม ที่ระบุข้างต้น ผู้ถือบัตรตกลงให้ถือว่าการกระทำดังกล่าวเป็นการกระทำของผู้ถือบัตร
  4. (ง)ผู้ถือบัตรตกลงให้บริษัทคิดค่าธรรมเนียมการเบิกถอนเงินสดในอัตราที่บริษัทกำหนด ซึ่งบริษัทจะประกาศให้ทราบเป็นคราว ๆ ไป แต่ไม่เกินอัตราสูงสุดที่บริษัทจะเรียกเก็บได้ตามกฎหมายที่มีผลใช้บังคับอยู่ในขณะนั้น ทั้งนี้ ผู้ถือบัตรสามารถใช้บัตรเบิกถอนเงินสดได้เป็นจำนวนไม่เกินวงเงินเบิกถอนเงินสดที่บริษัทกำหนด สำหรับการเบิกถอนเงินสด ณ เคาน์เตอร์ที่มีเครื่องหมาย VISA / MASTERCARD/JCB จำนวนเงินที่จะเบิกได้จะเป็นไปตามหลักเกณฑ์ที่ผู้ให้บริการนั้น ๆ เป็นผู้กำหนด
6. 1.6 นอกเหนือจากหลักเกณฑ์ตามข้อ 2.2 ผู้ถือบัตรตกลงว่าวงเงินของบัตรเครดิตรวมถึงวงเงินเบิกถอนเงินสดที่บริษัทอนุมัติให้ผู้ถือบัตรนั้นเป็นวงเงินที่บริษัทสามารถทำการพิจารณาเปลี่ยนแปลง (ไม่ว่าปรับเพิ่มหรือลด) ในภายหลังได้ตามหลักเกณฑ์ของบริษัท และเพื่อให้สอดคล้องกับหลักเกณฑ์ของธนาคารแห่งประเทศไทย โดยบริษัทจะดำเนินการทบทวนวงเงินของผู้ถือบัตร และสงวนสิทธิ์ที่จะปรับเพิ่มหรือลดวงเงินบัตรเครดิตและ/หรือวงเงินเบิกถอนเงินสดของผู้ถือบัตร (รวมถึงการยกเลิกวงเงินเบิกเงินสด) ภายใต้หลักเกณฑ์และระเบียบที่เกี่ยวข้อง ทั้งนี้ ขึ้นอยู่กับคุณสมบัติของผู้ถือบัตร ลักษณะการใช้บัตรประวัติการชำระเงิน และ/หรืออายุการเป็นสมาชิกบัตรของผู้ถือบัตร โดยผู้ถือบัตรสามารถทำการตรวจสอบวงเงินเบิกเงินสดของผู้ถือบัตรได้ที่ศูนย์บริการลูกค้าของบริษัท และ/หรือช่องทางการให้บริการอื่นใดที่บริษัทกำหนด
7. 1.7 ในการใช้บัตรแทนการชำระเงินสดนั้น ผู้ถือบัตรต้องตรวจสอบสินค้า/บริการ และยอดที่ต้องชำระว่าถูกต้องแล้ว จึงดำเนินการตามขั้นตอนการใช้บัตรชำระแทนเงินสดตามที่บริษัทและ/หรือร้านค้ากำหนด โดยผู้ถือบัตรจะต้องลงลายมือชื่อในเอกสารการขายหรือการให้บริการ (Sales Slip) หรืออุปกรณ์อื่นใดตามแบบที่บริษัทกำหนด เพื่อเป็นหลักฐานในการใช้บัตรแทนการชำระเงินทุกครั้ง เว้นแต่กรณีที่บริษัทหรือสถานประกอบการกำหนดไว้เป็นการเฉพาะว่าไม่ต้องลงลายมือชื่อในเอกสารการขายหรือการให้บริการ (Sales slip) หรืออุปกรณ์อื่นใด (แล้วแต่กรณี) ซึ่งไม่ว่าจะเป็นกรณีใดก็ตาม ผู้ถือบัตรยอมรับว่าเป็นการใช้บัตรชำระแทนเงินสดโดยสมบูรณ์แล้ว ทั้งนี้ ผู้ถือบัตรอาจขอรับใบเสร็จรับเงินจากสถานประกอบการเพื่อเป็นหลักฐานการซื้อสินค้าหรือบริการได้ แต่ใบเสร็จรับเงินดังกล่าวไม่ถือเป็นหลักฐานการชำระเงินของผู้ถือบัตรต่อบริษัท และไม่เป็นการปลดเปลื้องภาระรับผิดชอบของผู้ถือบัตรที่จะต้องชำระค่าใช้จ่ายดังกล่าวให้แก่บริษัทจนครบถ้วน
8. 1.8
  ในกรณีที่ผู้ถือบัตรสั่งซื้อสินค้าโดยใช้บัตรชำระค่าสินค้าหรือค่าใช้บริการโดยการแจ้งหมายเลขบัตรด้วยวาจาหรือแจ้งเป็นลายลักษณ์อักษรแก่ผู้ขายสินค้าหรือแก่ผู้ให้บริการเพื่อทำการเรียกเก็บเงินจากบริษัท ผู้ถือบัตรตกลงดังนี้
  1. (ก) หากเป็นการซื้อสินค้าหรือบริการผ่านเว็บไซต์หรือระบบเครือข่ายอินเตอร์เน็ต ผู้ถือบัตรตกลงยอมรับรายการที่เกิดขึ้น หากได้มีการกรอกข้อมูลและปฏิบัติตามวิธีการซื้อขายที่ถูกต้องดังที่ระบุในเว็บไซต์นั้น ๆ เว้นแต่ผู้ถือบัตรสามารถพิสูจน์ได้ว่าไม่ได้เป็นผู้ทำการซื้อสินค้าหรือบริการดังกล่าว และมีเหตุอันควรเชื่อพร้อมด้วยพยานหลักฐานสนับสนุนได้ว่ารายการที่เกิดขึ้นไม่ได้เกิดจากความผิดหรือประมาทเลินเล่อของผู้ถือบัตร หรือผู้ถือบัตรไม่มีส่วนเกี่ยวข้องกับการดำเนินการดังกล่าว หากได้ถูกเรียกเก็บเงินและผู้ถือบัตรได้ชำระเงินแล้ว บริษัทจะคืนเงินให้ผู้ถือบัตรตามวิธีการที่บริษัทกำหนด
  2. (ข) หากเป็นการทำรายการผ่านช่องทางอื่นนอกจากข้อ 1.8(ก) ผู้ถือบัตรมีสิทธิ์ขอยกเลิกการซื้อสินค้าหรือใช้บริการภายในระยะเวลา 45 วัน นับแต่วันที่สั่งซื้อหรือขอใช้บริการ หรือภายในระยะเวลา 30 วัน นับแต่วันที่ครบกำหนดการส่งมอบสินค้าหรือให้บริการกรณีที่มีการกำหนดระยะเวลาส่งมอบสินค้าหรือบริการเป็นลายลักษณ์อักษร หากผู้ถือบัตรพิสูจน์ได้ว่าไม่ได้เป็นผู้สั่งซื้อสินค้าหรือไม่ได้ขอใช้บริการ และมีเหตุอันเชื่อพร้อมด้วยพยานหลักฐานสนับสนุนได้ว่ารายการที่เกิดขึ้นไม่ได้เกิดจากการกระทำของผู้ถือบัตรหรือผู้ถือบัตรไม่มีส่วนเกี่ยวข้อง หรือเป็นผู้สั่งซื้อสินค้าแต่ได้รับไม่ตรงตามกำหนดเวลา หรือได้รับแล้วแต่ไม่ครบถ้วนหรือชำรุด บกพร่อง หรือไม่ถูกต้องตามวัตถุประสงค์ บริษัทจะระงับการเรียกเก็บเงินจากผู้ถือบัตร หรือกรณีเรียกเก็บเงินไปแล้วถ้าเป็นการสั่งซื้อสินค้าภายในประเทศ บริษัทจะคืนเงินให้ผู้ถือบัตรภายในระยะเวลา 30 วันนับแต่วันที่ผู้ถือบัตรแจ้ง ถ้าเป็นการซื้อสินค้าหรือบริการจากต่างประเทศ บริษัทจะคืนเงินให้ภายในระยะเวลา 60 วัน นับจากวันที่ได้รับแจ้งจากผู้ถือบัตร เว้นแต่บริษัทพิสูจน์ได้ว่าภาระหนี้ที่เกิดขึ้นเป็นการกระทำของผู้ถือบัตรเอง หรือมีเหตุอันเชื่อได้ว่ารายการที่เกิดขึ้นผู้ถือบัตรมีส่วนเกี่ยวข้อง โดยบริษัทจะใช้สิทธิเรียกเก็บเงินคืนจากผู้ถือบัตรในภายหลังโดยผู้ถือบัตรตกลงที่จะรับผิดในดอกเบี้ยและ/หรือ ค่าธรรมเนียมใด ๆ ที่เกิดขึ้นในช่วงระยะเวลาดังกล่าวด้วย
  3. (ค)
    ในกรณีที่บริษัทมีข้อตกลงเป็นการเฉพาะกับผู้ขายสินค้าหรือผู้ให้บริการที่ให้ผู้ถือบัตรสั่งซื้อสินค้าหรือใช้บริการที่ผู้ถือบัตรเพียงแจ้งความประสงค์ขอชำระค่าสินค้าหรือค่าบริการโดยการแจ้งหมายเลขบัตรด้วยวาจาหรือลายลักษณ์อักษร ให้ผู้ขายสินค้าหรือผู้ให้บริการทำการเรียกเก็บเงินจากบริษัท บริษัทและผู้ถือบัตรตกลงดังนี้
    
    1. ถ้าผู้ถือบัตรทักท้วงว่าไม่ได้เป็นผู้ทำการซื้อสินค้าหรือบริการดังกล่าว บริษัทจะระงับการเรียกเก็บเงินจากผู้ถือบัตรทันที หรือในกรณีที่เรียกเก็บเงินไปแล้ว บริษัทจะคืนเงินให้กับผู้ถือบัตรทันที เว้นแต่บริษัทจะพิสูจน์ได้ว่าภาระหนี้ที่เกิดขึ้นเป็นการกระทำของผู้ถือบัตรเองหรือมีเหตุอันเชื่อได้ว่ารายการที่เกิดขึ้นผู้ถือบัตร มีส่วนเกี่ยวข้องและมีสิทธิเรียกคืนจากผู้ถือบัตรในภายหลัง
    
    2. 45 วัน นับแต่วันที่สั่งซื้อหรือขอใช้บริการ หรือภายในระยะเวลา 30 วัน นับแต่วันที่ครบกำหนดการส่งมอบสินค้าหรือให้บริการกรณีที่มีการกำหนดระยะเวลาส่งมอบสินค้า หรือบริการเป็นลายลักษณ์อักษร หากผู้ถือบัตรพิสูจน์ได้ว่าไม่ได้รับสินค้าหรือไม่ได้รับบริการและมีเหตุอันเชื่อพร้อมด้วยพยานหลักฐานสนับสนุน ได้ว่ารายการที่เกิดขึ้นไม่ได้เกิดจากการกระทำของผู้ถือบัตรหรือผู้ถือบัตรไม่มีส่วนเกี่ยวข้อง หรือได้รับแต่ไม่ตรงตามกำหนดเวลา หรือได้รับแล้วแต่ไม่ครบถ้วนหรือชำรุดบกพร่องหรือไม่ถูกต้องตามวัตถุประสงค์ บริษัทจะระงับการเรียกเก็บเงินจากผู้ถือบัตร หรือกรณีเรียกเก็บเงินไปแล้วถ้าเป็นการสั่งซื้อสินค้าภายในประเทศ บริษัทจะคืนเงินให้ผู้ถือบัตรภายในระยะเวลา 30 วันนับแต่วันที่ผู้ถือบัตรแจ้ง ถ้าเป็นการซื้อสินค้าหรือบริการจากต่างประเทศ บริษัทจะคืนเงินให้ภายในระยะเวลา 60 วัน นับจากวันที่ได้รับแจ้งจากผู้ถือบัตร เว้นแต่บริษัทพิสูจน์ได้ว่าภาระหนี้ที่เกิดขึ้นเป็นการกระทำของผู้ถือบัตรเองหรือมีเหตุอันเชื่อได้ว่ารายการที่เกิดขึ้นผู้ถือบัตรมีส่วนเกี่ยวข้อง โดยบริษัทจะใช้สิทธิเรียกเก็บเงินคืนจากผู้ถือบัตรในภายหลังโดยผู้ถือบัตรตกลงที่จะรับผิดในดอกเบี้ยและ/หรือ ค่าธรรมเนียมใด ๆ ที่เกิดขึ้นในช่วงระยะเวลาดังกล่าวด้วย
9. 1.9
  ผู้ถือบัตรตกลงชำระหนี้อันเกิดจากการใช้บัตรตามอัตราและวิธีการที่ได้ตกลงไว้กับบริษัท โดยบริษัทจะส่งใบแจ้งยอดบัญชี และ/หรือ ใบกำกับภาษี และ/หรือ ใบรับ (ซึ่งอาจจะอยู่ในรูปแบบกระดาษหรือในรูปแบบอิเล็กทรอนิกส์) ทางไปรษณีย์ หรือทางไปรษณีย์อิเล็กทรอนิกส์ หรือทางแอปพลิเคชันที่ติดตั้งบนโทรศัพท์เคลื่อนที่ หรืออุปกรณ์อิเล็กทรอนิกส์อื่นใดของผู้ถือบัตร หรือให้ผู้ถือบัตรตรวจสอบจากเว็บไซต์ของบริษัท หรือโปรแกรมของบริษัท และ/หรือ ช่องทางอื่นใดที่บริษัทจัดทำขึ้น เป็นระยะเวลาไม่น้อยกว่า 10 วันล่วงหน้าก่อนวันถึงกำหนดชำระ และผู้ถือบัตรตกลงชำระเงินค่าสินค้า ค่าบริการ หนี้อื่นใดอันเกิดจากการใช้บัตร โดยผู้ถือบัตรหลักและ/หรือผู้ถือบัตรเสริม รวมทั้งค่าธรรมเนียมอื่น ๆ ให้บริษัทภายในวันที่กำหนดในใบแจ้งยอดบัญชีบัตรเครดิต ยอดเงินขั้นต่ำที่แสดงไว้ในใบแจ้งยอดบัญชีบัตรเครดิตจะเป็นยอดเงินขั้นต่ำที่ผู้ถือบัตรต้องชำระในแต่ละเดือน ในกรณีที่ผู้ถือบัตรเห็นว่าใบแจ้งยอดบัญชีบัตรเครดิตที่ได้รับไม่ถูกต้องทั้งหมดหรือบางส่วนไม่ว่าด้วยประการใด ผู้ถือบัตรจะต้องปฏิบัติ ดังนี้
  1. 1. ทักท้วงภายใน 10 วันทำการนับตั้งแต่วันที่ผู้ถือบัตรได้รับใบแจ้งยอดบัญชีจากบริษัทและ/หรือวันที่บริษัททำการแจ้งให้ท่านตรวจสอบข้อมูลใบแจ้งยอดบัญชีจากเว็บไซต์ หรือโปรแกรมของบริษัท และ/หรือ ช่องทางอื่นใดที่บริษัทจัดทำขึ้น ในการพิจารณาวันครบกำหนดดังกล่าว หากเป็นการจัดส่งทางไปรษณีย์ บริษัทจะนำสืบวัน เวลา ที่นำส่งใบแจ้งยอดบัญชีให้แก่ผู้ขนส่ง หรือหากเป็นการจัดส่งทางจดหมายอิเล็กทรอนิกส์ (e-mail) บริษัทจะนำสืบวัน เวลาที่ส่งใบแจ้งยอดบัญชี
  2. 2. ในกรณีที่บริษัทตรวจสอบแล้วเห็นว่ารายการในใบแจ้งยอดบัญชีนั้นถูกต้องแล้ว ผู้ถือบัตรจะต้องพิสูจน์ว่ารายการและยอดค่าใช้จ่ายตามที่ปรากฎในใบแจ้งยอดบัญชีไม่ถูกต้อง และความไม่ถูกต้องนั้นไม่ได้เกิดขึ้นจากความผิดหรือความบกพร่องของผู้ถือบัตรเอง ทั้งนี้ ผู้ถือบัตรจะต้องทักท้วงภายในระยะเวลาไม่เกิน 60 วัน นับแต่วันที่ผู้ถือบัตรได้รับในใบแจ้งยอดบัญชีจากบริษัท ทั้งนี้ ในกรณีผู้ถือบัตรต้องการสำเนาใบแจ้งยอดบัญชี เพื่อตรวจสอบรายการที่เกิดจากการใช้บัตร ผู้ถือบัตรตกลงจ่ายค่าธรรมเนียมการออกสำเนาใบแจ้งยอดบัญชีในอัตราที่บริษัทกำหนดให้แก่บริษัทเมื่อบริษัทได้จัดส่งใบแจ้งยอดบัญชี และ/หรือ ใบกำกับภาษี และ/หรือ ใบรับ ด้วยวิธีการใดวิธีการหนึ่งดังที่ระบุในข้อนี้ตามที่ผู้ถือบัตรได้แจ้งความประสงค์ต่อบริษัทแล้ว ให้ถือว่าบริษัทได้จัดส่งใบแจ้งยอดบัญชี และ/หรือ ใบกำกับภาษี และ/หรือ ใบรับอย่างสมบูรณ์และถูกต้องตามกฎหมายแล้วในกรณีที่ผู้ถือบัตรมีความประสงค์ที่จะเปลี่ยนรูปแบบใบแจ้งยอดบัญชี และ/หรือ ใบกำกับภาษี และ/หรือ ใบรับ ผู้ถือบัตรจะต้องแจ้งให้บริษัททราบเป็นลายลักษณ์อักษรล่วงหน้าเป็นระยะเวลาไม่น้อยกว่า 30 วัน
10. 1.10
  ผู้ถือบัตรรับทราบและตกลงว่าค่าใช้จ่ายใด ๆ ที่เกิดจากการใช้จ่ายผ่านบัตร (รวมถึงการเบิกเงินสด) เป็นสกุลเงินตราต่างประเทศจะถูกเรียกเก็บเป็นเงินบาทไทยตามอัตราแลกเปลี่ยน ที่บริษัทถูกเรียกเก็บจากบริษัทบัตรเครดิตที่บริษัทเป็นสมาชิกอยู่ ณ วันที่มีการเรียกเก็บยอดค่าใช้จ่ายดังกล่าวกับบริษัท ทั้งนี้ หากสกุลเงินต่างประเทศดังกล่าวไม่ใช่เป็นสกุลเงินดอลล่าร์สหรัฐ ยอดค่าใช้จ่ายดังกล่าวอาจจะถูกแปลงเป็นสกุลเงินดอลล่าร์สหรัฐก่อนที่จะทำการแปลงเป็นสกุลเงินบาทเพื่อเรียกเก็บกับบริษัท ทั้งนี้ ผู้ถือบัตรสามารถตรวจสอบอัตราแลกเปลี่ยน เพื่อใช้ในการอ้างอิงเบื้องต้นได้จาก
  
  สำหรับบัตร VISA: คลิก
  สำหรับบัตร MasterCard: คลิก
  และสำหรับบัตร JCB: คลิก
  
  นอกจากนี้ ผู้ถือบัตรรับทราบและตกลงให้บริษัทคิดค่าความเสี่ยงจากการแปลงสกุลเงินดังกล่าวในอัตราที่บริษัทกำหนดและแจ้งให้ทราบในตารางค่าธรรมเนียม เพื่อป้องกันความเสี่ยงที่เกิดจากการแปลงสกุลเงินดังกล่าวข้างต้น รวมทั้งค่าธรรมเนียมการใช้บัตรฯ เป็นสกุลเงินบาท ณ ร้านค้าที่จดทะเบียนในต่างประเทศ ในอัตราที่บริษัทกำหนดและแจ้งให้ทราบในตารางค่าธรรมเนียม
11. 1.11 กรณีที่บัตรสูญหาย หรือถูกโจรกรรม หรือไม่ว่าด้วยสาเหตุใด ๆ ผู้ถือบัตรมีสิทธิยกเลิกหรือระงับการใช้บริการบัตรชั่วคราว โดยแจ้งให้บริษัททราบทันทีตามวิธีการที่บริษัทกำหนด หลังจากบริษัทได้รับแจ้งแล้วบริษัทจะระงับการให้บริการบัตรดังกล่าวภายใน 5 นาที นับแต่เวลาที่ได้รับแจ้งทั้งนี้ หากบริษัทไม่ได้รับแจ้งดังกล่าวข้างต้น ผู้ถือบัตรต้องรับผิดชอบในภาระหนี้ที่เกิดขึ้นทั้งหมด อนึ่ง ผู้ถือบัตรไม่ต้องรับผิดชอบในภาระหนี้ที่เกิดขึ้นภายหลังจากครบกำหนดระยะเวลา 5 นาที ดังกล่าว (รวมถึงแต่ไม่จำกัดเพียงค่าธรรมเนียมต่าง ๆ (ถ้ามี)) เว้นแต่บริษัทจะตรวจสอบและพิสูจน์ได้ว่าภาระหนี้ที่เกิดขึ้น (ไม่ว่าก่อนหรือหลังการแจ้ง) เกิดจากการกระทำของผู้ถือบัตร หรือมีเหตุอันเชื่อได้ว่าผู้ถือบัตรมีส่วนรู้เห็นหรือมีส่วนเกี่ยวข้อง หรือประมาทเลินเล่อ ผู้ถือบัตรตกลงรับผิดชอบในภาระหนี้ดังกล่าวเต็มจำนวนในกรณีที่ผู้ถือบัตรมีสิทธิได้รับความคุ้มครองพิเศษเพิ่มเติมจากการเป็นสมาชิกบัตรบางประเภทเกี่ยวกับการชดเชยกรณีบัตรสูญหายหรือถูกโจรกรรม ผู้ถือบัตรจะได้รับสิทธิตามเงื่อนไขความคุ้มครองตามที่บริษัทกำหนดและแจ้งให้ทราบผ่านช่องทางต่าง ๆ เช่น คู่มือสิทธิประโยชน์ หรือเว็บไซต์ หรือช่องทางอื่นใดที่บริษัทกำหนด
12. 1.12 ในกรณีที่มีการทำธุรกรรมผ่านบัญชีบัตรโดยบุคคลอื่น (ไม่ว่าโดยการใช้บัตรหรือไม่ก็ตาม) ผู้ถือบัตรจะต้องแจ้งให้บริษัททราบถึงเหตุการณ์ดังกล่าวทันทีเพื่อทำการระงับการใช้บัตรและยกเลิกรหัสประจำตัว โดยหลังจากบริษัทได้รับแจ้งแล้วบริษัทจะระงับการให้บริการบัตรดังกล่าวภายใน 5 นาที นับแต่เวลาที่ได้รับแจ้ง ทั้งนี้ หากบริษัทไม่ได้รับแจ้งดังกล่าวข้างต้น ผู้ถือบัตรต้องรับผิดชอบในภาระหนี้ที่เกิดขึ้นทั้งหมด อนึ่ง ผู้ถือบัตรไม่จำต้องรับผิดในภาระหนี้ที่เกิดขึ้นหลังจากครบระยะเวลา 5 นาทีนับแต่เวลาได้แจ้งเหตุให้บริษัททราบ (รวมถึงแต่ไม่จำกัดเพียงค่าธรรมเนียมต่าง ๆ (ถ้ามี)) เว้นแต่ในกรณีที่บริษัทตรวจสอบและพิสูจน์ได้ว่าภาระหนี้ที่เกิดขึ้นดังกล่าว (ไม่ว่าก่อนหรือหลังการแจ้ง) เกิดขึ้นจากการกระทำของผู้ถือบัตร หรือมีเหตุอันเชื่อได้ว่าผู้ถือบัตรมีส่วนรู้เห็นหรือมีส่วนเกี่ยวข้อง หรือประมาทเลินเล่อ ผู้ถือบัตรตกลงรับผิดชอบในภาระหนี้ดังกล่าวเต็มจำนวนในกรณีที่ผู้ถือบัตรมีสิทธิได้รับความคุ้มครองพิเศษเพิ่มเติมจากการเป็นสมาชิกบัตรบางประเภทเกี่ยวกับการชดเชยกรณีการทำธุรกรรมผ่านบัญชีบัตรโดยบุคคลอื่น ผู้ถือบัตรจะได้รับสิทธิตามเงื่อนไขความคุ้มครองตามที่บริษัทกำหนดและแจ้งให้ทราบผ่านช่องทางต่าง ๆ เช่น คู่มือสิทธิประโยชน์ หรือเว็บไซต์ หรือช่องทางอื่นใดที่บริษัทกำหนด
13. 1.13 ในกรณีตามข้อ 1.11 และ 1.12 หากผู้ถือบัตรต้องการให้บริษัทออกบัตรให้ใหม่ ผู้ถือบัตรจะต้องรับผิดชอบค่าใช้จ่ายและหนี้ที่เกิดขึ้นจากบัตรใบเดิม (ในส่วนที่ผู้ถือบัตรต้องรับผิดชอบ) และผู้ถือบัตรจะต้องจ่ายค่าธรรมเนียมในการออกบัตรใหม่ในอัตราที่บริษัทได้แจ้งให้ผู้ถือบัตรทราบ และหากผู้ถือบัตรพบหรือได้รับบัตรที่สูญหาย หรือบัตรที่มีการทำธุรกรรมโดยบุคคลอื่นคืน (แล้วแต่กรณี) ผู้ถือบัตรต้องทำลายบัตรเดิม เพื่อป้องกันมิให้มีการนำบัตรไปใช้ได้อีก
14. 1.14 ผู้ถือบัตรสามารถแจ้งบริษัทเพื่อยกเลิกการใช้บัตรเป็นการถาวรเมื่อใดก็ได้โดยแจ้งไปยังบริษัทและ/หรือ โดยการตัดบัตรออกเป็น 2 ส่วนและส่งคืนไปยังบริษัท ทั้งนี้ ผู้ถือบัตรสามารถร้องขอค่าธรรมเนียมรายปีตามส่วนของระยะเวลาที่ยังมิได้ใช้บริการจากบริษัท ทั้งนี้ บริษัทสามารถพิจารณานำต้นทุนหรือค่าใช้จ่ายที่เกิดขึ้นจริงมาหักออกจากค่าบริการดังกล่าวก่อนคืนได้ โดยผู้ถือบัตรจะต้องทำเรื่องขอคืนค่าธรรมเนียมภายใน 1 ปีนับจากวันที่แจ้งยกเลิก และบริษัทจะคืนค่าธรรมเนียมรายปีเข้ายังบัญชีบัตรเครดิตของผู้ถือบัตร และการคืนค่าธรรมเนียมรายปีของบัตรเสริมจะคืนเข้ายังบัญชีของบัตรหลัก
15. 1.15 กรณีการใช้ข้อมูลบัตรในการทำธุรกรรมออนไลน์ และต้องมีการยืนยันการทำธุรกรรมด้วยรหัสผ่านครั้งเดียว (One-Time Password – OTP) ซึ่งบริษัทจะนำส่งรหัสผ่านให้ผู้ถือบัตรไปยังหมายเลขโทรศัพท์มือถือของผู้ถือบัตรที่ได้ลงทะเบียนไว้กับบริษัท หรือผ่านแอปพลิเคชัน หรือโปรแกรมของบริษัท ที่ผู้ถือบัตรได้ลงทะเบียนไว้กับบริษัท และ/หรือ ช่องทางอื่นใดที่บริษัทจัดทำขึ้น ผู้ถือบัตรตกลงว่าการยืนยันการทำธุรกรรมโดยวิธีดังกล่าวถือเป็นการลงลายมือชื่อทางอิเล็กทรอนิกส์ของผู้ถือบัตรและผู้ถือบัตรตกลงรับผิดชอบในรายการใช้จ่ายที่เกิดขึ้นทุกประการ
16. 1.16 ผู้ถือบัตรตกลงว่าบริษัทและบริษัทข้อมูลเครดิต บริษัทประมวลผลข้อมูลเครดิตอื่น ๆ ที่บริษัทเป็นสมาชิกอยู่ จะเปิดเผย แลกเปลี่ยน โอน และ/หรือ ส่ง หรือส่งไปยังต่างประเทศ ซึ่งข้อมูลส่วนตัว และ/หรือข้อมูลเครดิต และ/หรือข้อมูลอื่นใดที่มีอยู่ในใบสมัคร หรือการสื่อสารใด ๆ ที่มีอยู่กับบริษัท บริษัทข้อมูลเครดิต บริษัทประมวลผลข้อมูลเครดิตอื่น ๆ ธนาคาร สถาบันการเงินและนิติบุคคลอื่น ๆ ที่เป็นสมาชิกบริษัทข้อมูลเครดิต บริษัทประมวลผลข้อมูลอื่น ๆ บริษัทแม่ และบริษัทในเครือของบริษัท เพื่อประโยชน์ในการปฏิบัติตามสัญญาระหว่างบริษัทและผู้ถือบัตร เพื่อสนับสนุนการให้บริการของบริษัท และเพื่อประโยชน์ในการดำเนินการติดตามทวงถามหนี้ ซึ่งหากผู้ถือบัตรไม่ยินยอมดังกล่าว อาจกระทบต่อการดำเนินการของบริษัทอย่างมีนัยสำคัญ และ/หรือจะทำให้ไม่สามารถให้บริการได้อย่างเป็นธรรมและต่อเนื่อง เช่น การเปิดเผยข้อมูลเพื่อประโยชน์ในการพิสูจน์และยืนยันตัวตนของลูกค้าทางดิจิทัล การพิจารณาสินเชื่อ การทบทวนสินเชื่อ หรือการประเมินเครดิตของผู้ถือบัตร หรือการบริหารความเสี่ยงด้านเครดิต การเปิดเผยข้อมูลแก่ผู้ให้บริการภายนอก หรือ ตัวแทนของบริษัท หรือผู้ให้บริการสนับสนุนการประกอบธุรกิจ หรือผู้รับจ้างช่วงงานต่อ เพื่อให้บุคคลดังกล่าวดำเนินงานตามที่ได้รับมอบหมายจากบริษัทได้ พันธมิตร ร้านค้า และพันธมิตรทางธุรกิจที่ออกผลิตภัณฑ์ร่วมกันในลักษณะ co-brand หน่วยงานราชการตามกฎหมาย ในกรณีที่ผู้ถือบัตรได้ปิดบัญชี หรือยกเลิกการใช้บริการของบริษัทไปแล้ว ให้บริษัทสามารถจัดเก็บหรือเปิดเผยข้อมูลส่วนตัว ข้อมูลเครดิต และ/หรือข้อมูลอื่นใดที่อยู่ในใบสมัครและฐานข้อมูลของบริษัท เพื่อการปฏิบัติหน้าที่ตามกฎหมาย และผู้ถือบัตรตกลงให้บริษัทสามารถนำผลการตรวจสอบดังกล่าวมาใช้ในการพิจารณาคุณสมบัติของผู้ถือบัตรว่ามีลักษณะเข้าข่ายกรณีต่าง ๆ ตามข้อ 2.2 หรือไม่
17. 1.17 ผู้ถือบัตรตกลงว่าบริษัทจะเปิดเผย แลกเปลี่ยน ส่ง และ/หรือ โอนข้อมูลของผู้ถือบัตรที่ให้ไว้กับบริษัท ทั้งในใบสมัคร หรือทางการสื่อสารใด ๆ ตลอดจนข้อมูลใด ๆ เช่น หมายเลขโทรศัพท์ หมายเลขโทรศัพท์มือถือ ที่อยู่ และ/หรือที่อยู่จดหมายอิเล็กทรอนิกส์ (e-mail address) และ/หรือช่องทางอื่นใดของผู้ถือบัตร ข้อมูลเกี่ยวกับหนี้สินของผู้ถือบัตร แก่บริษัทในเครือ ผู้ให้บริการภายนอก หรือตัวแทนของบริษัท หรือผู้ให้บริการสนับสนุนการประกอบธุรกิจ หรือผู้รับจ้างช่วงงานต่อ เพื่อให้บุคคลดังกล่าวดำเนินงานตามที่ได้รับมอบหมายจากบริษัทได้ พันธมิตร ร้านค้า และพันธมิตรทางธุรกิจที่ออกผลิตภัณฑ์ร่วมกันในลักษณะ co-brand หน่วยงานราชการตามกฎหมาย รวมทั้งการใช้เพื่อวัตถุประสงค์ในการติดต่อสื่อสารหรือการส่งใบแจ้งยอดบัญชี และ/หรือส่งข้อมูลหรือเอกสารเกี่ยวกับข้อมูลเครดิตแก่ผู้ถือบัตรผ่านทางระบบสื่อสารทางอินเตอร์เน็ตหรือคอมพิวเตอร์ หรือเพื่อพิจารณาความสามารถในการชำระหนี้ หรือการประเมินเครดิตของผู้ถือบัตร หรือการบริหารความเสี่ยงด้านเครดิต ทบทวนวงเงินสินเชื่อ รวมทั้งการติดตามทวงถามหนี้ค้างชำระ (หากมี) โดยระบุจำนวนค้างชำระได้ และผู้ถือบัตรจะแจ้งให้บริษัททราบทันทีหากมีการเปลี่ยนแปลงใด ๆ ทั้งนี้ สำหรับการติดตามทวงถามหนี้ค้างชำระ (หากมี) นั้น ผู้ถือบัตรรับทราบและตกลงว่าบริษัทจะทำการมอบหมายให้กับบุคคลอื่นเพื่อดำเนินการแทนบริษัท หรืออาจจะดำเนินการด้วยตนเองก็ได้ รวมถึงตกลงให้บริษัทสามารถรับชำระหนี้ใด ๆ ตามบัตรของผู้ถือบัตรจากบุคคลอื่นได้ตามที่เห็นสมควร เพื่อประโยชน์ในการติดตามทวงถามหนี้ค้างชำระของผู้ถือบัตร ทั้งนี้ บริษัทจะดำเนินการตามหลักเกณฑ์ของบริษัทซึ่งอยู่ภายใต้ระเบียบและกฎหมายที่เกี่ยวข้อง
18. 1.18 ผู้ถือบัตรจะต้องแจ้งให้บริษัททราบทันทีในกรณีที่มีการเปลี่ยนแปลงชื่อ นามสกุล อาชีพ สถานที่ทำงาน สถานที่อยู่ หมายเลขโทรศัพท์ หมายเลขโทรศัพท์มือถือ ที่อยู่ไปรษณีย์อิเล็กทรอนิกส์ และรายละเอียดอื่น ๆ ทั้งนี้ บรรดาเอกสารหรือหนังสือใด ๆ ที่บริษัทส่งไปยังผู้ถือบัตร หากส่งไปยังที่อยู่และ/หรือที่ทำงาน และ/หรือที่อยู่ไปรษณีย์อิเล็กทรอนิกส์ หรือผ่านช่องทางตามที่ผู้ถือบัตรได้แจ้งไว้ ให้ถือว่าส่งให้ผู้ถือบัตรแล้วโดยชอบ
19. 1.19 หากบริษัทมิได้แจ้งยกเลิก เรียกคืน หรือระงับการใช้บัตรตามข้อ 2.2 ผู้ถือบัตรสามารถนำบัตรนี้ไปใช้ได้จนถึงวันที่บัตรหมดอายุซึ่งได้กำหนดไว้บนบัตรทั้งนี้ การพิจารณาอนุมัติบัตรใหม่ให้กับผู้ถือบัตรนั้นจะเป็นไปตามหลักเกณฑ์และดุลพินิจของบริษัทอย่างไรก็ดี หากบริษัทพิจารณาอนุมัติบัตรใหม่ให้ ผู้ถือบัตรตกลงยอมรับบัตรใหม่ดังกล่าวและเปิดใช้บัตรตามวิธีที่บริษัทกำหนด หรือในกรณีที่บริษัทไม่อนุมัติบัตรใหม่ให้ถือว่าสิทธิ์ของผู้ถือบัตรตามสัญญานี้สิ้นสุดลงโดยผู้ถือบัตรมีหน้าที่ต้องชำระหนี้ใด ๆ ที่คงค้างตามสัญญานี้ต่อไปจนกว่าจะชำระครบถ้วนหมดสิ้นทั้งจำนวน
20. 1.20 ผู้ถือบัตรตกลงและยินยอมให้บริษัทนำเงินที่ได้รับชำระจากผู้ถือบัตรไปหักจากยอดเงินที่บริษัทเรียกเก็บโดยมีเงื่อนไขการชำระเงินและลำดับการหักยอดเงิน ตามที่ระบุไว้ในใบแจ้งยอดบัญชีบัตรที่บริษัทจัดส่งให้กับผู้ถือบัตร

2. สิทธิหน้าที่ของบริษัท
1. 2.1 บริษัทเป็นเพียงผู้ให้บริการบัตรเครดิตซึ่งเป็นตัวกลางการชำระเงินค่าสินค้าและ/หรือบริการ จึงไม่มีหน้าที่ที่จะต้องรับผิดชอบในกรณีที่ธนาคาร ร้านค้า หรือผู้ประกอบการไม่รับบัตรหรือปฏิเสธการรับบัตรของผู้ถือบัตรในการทำธุรกรรมต่าง ๆ และบริษัทไม่จำต้องรับผิดชอบในข้อตกลงหรือเงื่อนไขใด ๆ ที่เกี่ยวกับการจำหน่ายสินค้าหรือบริการซึ่งผู้ถือบัตรได้ทำไว้กับร้านค้า ผู้ขายสินค้าหรือผู้ให้บริการ หรือสถานที่เหล่านั้น กรณีที่มีข้อพิพาทอันเกี่ยวกับสินค้าหรือบริการของร้านค้าหรือผู้ประกอบการ ผู้ถือบัตรตกลงที่จะเรียกร้องหรือดำเนินคดีกับร้านค้าหรือผู้ประกอบการโดยตรง และจะไม่เรียกร้องให้บริษัทยกเลิกรายการทำธุรกรรมดังกล่าว รวมถึงจะไม่เรียกร้องให้บริษัทร่วมรับผิดด้วย เว้นแต่กฎหมายจะกำหนดความรับผิดของบริษัทไว้เป็นอย่างอื่น ทั้งนี้ ผู้ถือบัตรตกลงว่าบริษัทมีสิทธิ์ระงับหรือไม่อนุมัติการทำธุรกรรมที่มีวัตถุประสงค์เป็นการต้องห้ามชัดแจ้งตามกฎหมาย เป็นการพ้นวิสัยหรือเป็นการขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชน รวมถึงการใช้บัตรใด ๆ ที่เป็นไปในลักษณะผิดวัตถุประสงค์ปกติของการใช้บัตร หรือการใช้บัตรในเชิงพาณิชย์ หรือใช้ในการประกอบธุรกิจของผู้ถือบัตร/บุคคลอื่น หรือมีลักษณะการใช้บัตรในทางการค้าหรือหากำไร หรือแสวงหาผลประโยชน์โดยมิชอบให้กับตนเองหรือผู้อื่น หรือมีพฤติการณ์ที่ไม่เหมาะสมส่อไปในทางทุจริต
2. 2.2
  บริษัทสงวนสิทธิ์ในการลดวงเงิน พิจารณาไม่ต่ออายุบัตร ระงับสิทธิ์การใช้บัตร และ/หรือ งดเว้นการให้บริการอย่างหนึ่งอย่างใด และ/หรือยกเลิกหรือเพิกถอนการเป็นผู้ถือบัตร (ทั้งบัตรหลักและ/หรือบัตรเสริม) ในกรณีที่เกิดเหตุแห่งการผิดสัญญา หรือเหตุแห่งการบอกเลิกสัญญาเหตุใดเหตุหนึ่งดังต่อไปนี้ขึ้น ทั้งนี้ เฉพาะการแจ้งระงับหรือยกเลิกหรือเพิกถอนการเป็นผู้ถือบัตร บริษัทจะแจ้งให้ทราบเป็นหนังสือ โดยผู้ถือบัตรยังคงต้องรับผิดชอบในยอดคงค้างที่ยังไม่ได้ชำระให้กับบริษัทภายในเวลาที่บริษัทกำหนดในหนังสือแจ้งการระงับหรือเพิกถอนสิทธิ์ดังกล่าว
  1. (ก) ผู้ถือบัตรปกปิดข้อมูลที่ควรแจ้ง หรือแจ้งข้อมูลไม่ครบถ้วน หรือข้อมูลอันเป็นเท็จให้แก่บริษัท หรือจัดให้บริษัทเข้าถึงข้อมูลของบุคคลอื่น ซึ่งทำให้บริษัทสำคัญผิดในคุณสมบัติของผู้ถือบัตร ในการสมัครเป็นผู้ถือบัตรไม่ว่าข้อความอันเป็นเท็จนั้นจะได้ปรากฎขึ้นหรือเป็นที่รับทราบของบริษัทก่อน หรือภายหลังการออกบัตรให้ผู้ถือบัตร หรือบริษัทตรวจสอบพบในภายหลังว่าการสมัครหรือการอนุมัติบัตรเกิดจากการสำคัญผิด หรือเกิดจากการดำเนินการโดยทุจริต
  2. (ข) ผู้ถือบัตรไม่ปฏิบัติตามข้อกำหนดหรือเงื่อนไขข้อหนึ่งข้อใดของสัญญานี้ หรือดำเนินการใด ๆ อันไม่เป็นไปตามวิธีการที่บริษัทกำหนด
  3. (ค) ผู้ถือบัตรผิดนัดไม่ชำระหนี้ใด ๆ ที่ค้างชำระเมื่อถึงกำหนดชำระไม่ว่ากับบริษัทหรือบุคคลใด ๆ หรือผิดนัดไม่ชำระหนี้ที่ค้างชำระกับบริษัทเมื่อถึงกำหนดชำระเป็นจำนวนรวมกันตั้งแต่ 2 งวดขึ้นไปภายในรอบ 6 เดือน หรือมีเหตุอันควรเชื่อว่าผู้ถือบัตรอาจไม่สามารถชำระหนี้ได้จนเสร็จสิ้น
  4. (ง) เกิดการเปลี่ยนแปลงฐานะทางการเงินของผู้ถือบัตรหรือรายได้จากแหล่งที่มาต่าง ๆ (หรือผู้ถือบัตรมีภาระหนี้หรือวงเงินไม่ว่ากับบริษัท หรือสถาบันการเงินหรือนิติบุคคลอื่นสูงเกินกว่ารายได้) และบริษัทพิจารณาแล้วเห็นว่า ผู้ถือบัตรเป็นผู้มีฐานะการเงินไม่เพียงพอสำหรับการชำระหนี้ที่เกิดขึ้นจากการใช้บัตรหรือผู้ถือบัตรประสบปัญหาอื่นใดอันเป็นสาระสำคัญ ซึ่งมีผลต่อการชำระหนี้ของผู้ถือบัตร
  5. (จ) ผู้ถือบัตรเข้าร่วมโครงการปรับปรุงโครงสร้างหนี้ และ/หรือโครงการหรือมาตรการช่วยเหลืออื่นใด ซึ่งระบุเงื่อนไขในการระงับการใช้บัตร และ/หรือยกเลิกสัญญาการใช้บัตรเครดิต
  6. (ฉ) บริษัทพบว่าผู้ถือบัตรใช้บัตรผิดวัตถุประสงค์ที่ระบุไว้ในสัญญานี้และ/หรือมีพฤติกรรมหรือคุณสมบัติที่ผิดปกติหรือไม่เหมาะสมในการใช้บัตรหรือเป็นสมาชิกผู้ถือบัตร (รวมถึงแต่ไม่จำกัดเพียงการนำสิทธิประโยชน์ที่ได้รับจากการเป็นสมาชิกบัตรไปโอนและ/หรือจำหน่าย ไม่ว่าได้รับค่าตอบแทนหรือไม่ ให้แก่บุคคลอื่นโดยไม่ได้รับอนุญาตล่วงหน้าเป็นลายลักษณ์อักษรจากบริษัท) รวมถึงการใช้บัตรเพื่อประโยชน์ทางธุรกิจ หรือการใช้บัตรในเชิงพาณิชย์ หรือมีลักษณะการใช้บัตรเพื่อแสวงหาผลประโยชน์โดยมิชอบให้กับตนเองหรือผู้อื่น หรือมีพฤติกรรมการใช้บัตรในทางฉ้อฉล หรือทุจริต หรือเพื่อวัตถุประสงค์ที่ไม่เหมาะสมหรือไม่ชอบด้วยกฎหมาย (รวมถึงแต่ไม่จำกัดเพียงการปลอมและการใช้เอกสารปลอมในการขอใช้บัตร และ/หรือการกระทำอันมีเหตุอันควรสงสัยว่าจะเป็นการฟอกเงิน) หรือเป็นการพ้นวิสัยหรือเป็นการขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชน
  7. (ช) ผู้ถือบัตรถูกดำเนินคดีแพ่ง หรือถูกกล่าวหาเป็นคดีอาญา หรืออยู่ระหว่างถูกพิทักษ์ทรัพย์ หรือตกเป็นบุคคลล้มละลายตามคำพิพากษา หรือเป็นบุคคลที่ถูกหน่วยงานราชการหรือหน่วยงานที่มีอำนาจมีคำสั่งให้ยึด/อายัดทรัพย์ หรือมีพฤติกรรมอันถือได้ว่าเป็นการฉ้อฉลบริษัทหรือสถาบันการเงินหรือบุคคล/นิติบุคคลอื่น
  8. (ซ) ผู้ถือบัตรถึงแก่ความตาม สาบสูญ หรือตกเป็นบุคคลไร้ความสามารถหรือเสมือนไร้ความสามารถ ตามแต่กรณี หรือมีคุณสมบัติไม่เหมาะสมหรือไม่ถูกต้องครบถ้วนตามที่บริษัทกำหนด
  9. (ฌ) ผู้ถือบัตรไม่แสดงหรือไม่สามารถแสดงหลักฐานเงินได้ขั้นต่ำตามที่ธนาคารแห่งประเทศไทยหรือหน่วยงานราชการที่เกี่ยวข้องกำหนดภายในระยะเวลาที่บริษัทกำหนด(ญ) เกิดการเปลี่ยนแปลงทางกฎหมาย กฎกระทรวงและ/หรือประกาศของหน่วยราชการที่เกี่ยวข้อง ซึ่งมีผลกระทบอย่างมีนัยสำคัญแก่การประกอบกิจการของบริษัทและ/หรือการให้บริการของบริษัทตามสัญญาฉบับนี้หรือบริษัทตัดสินใจยกเลิกการให้บริการบัตรเครดิตตามสัญญานี้
  10. (ฎ) ในกรณีที่ผู้ถือบัตรไม่มียอดคงค้าง หรือไม่มียอดใช้จ่ายผ่านบัญชีของผู้ถือบัตร หรือไม่มีการเคลื่อนไหวทางบัญชี หรือไม่ได้มีการติดต่อกับบริษัทและ/หรือบริษัทไม่สามารถติดต่อผู้ถือบัตรได้ (กรณีใดกรณีหนึ่ง) เป็นเวลาติดต่อกันอย่างน้อย 12 เดือนหรือระยะเวลาอื่นใดตามที่บริษัทกำหนด
  11. (ฏ) กรณีอื่น ๆ ตามที่บริษัทจะประกาศให้ทราบต่อไป ทั้งนี้ ในกรณีที่บัตรหลักถูกระงับหรือถูกยกเลิก (รวมถึงกรณีที่ไม่ได้รับการต่ออายุบัตร) จะมีผลทำให้บัตรเสริมถูกระงับและ/หรือถูกยกเลิกพร้อมกันกับบัตรหลักทันที อย่างไรก็ดี กรณีผู้ถือบัตรเสียชีวิต ให้ถือว่าสัญญาฉบับนี้สิ้นสุดลง และบริษัทมีสิทธิเรียกร้องในยอดหนี้ค้างชำระทันทีโดยบริษัทไม่จำต้องส่งคำบอกกล่าวเพื่อเลิกสัญญา
3. 2.3 ในระหว่างที่มีเหตุแห่งการผิดสัญญา หรือเหตุแห่งการบอกเลิกสัญญาเหตุใดเหตุหนึ่งเกิดขึ้น (นอกเหนือจากสิทธิ์ในการลดวงเงิน พิจารณาไม่ต่ออายุบัตร ระงับสิทธิ์การใช้ และ/หรือยกเลิกหรือเพิกถอนการเป็นผู้ถือบัตรเมื่อเกิดเหตุการณ์ใดเหตุการณ์หนึ่งตามที่ระบุในข้อ 2.2 ข้างต้นแล้ว) บริษัทขอสงวนสิทธิ์ในการยกเลิกหรือระงับการให้บริการอย่างหนึ่งอย่างใด หรือยกเลิกสิทธิพิเศษหรือสิทธิประโยชน์ใด ๆ ที่ได้ให้กับผู้ถือบัตร (รวมถึงแต่ไม่จำกัดเพียงการยกเว้นค่าธรรมเนียมรายปีและ/หรือกรณีการที่ผู้ถือบัตรได้รับอัตราค่าธรรมเนียมสินเชื่อในอัตราพิเศษ) โดยเมื่อมีเหตุแห่งการผิดสัญญาหรือเหตุแห่งการบอกเลิกสัญญาเหตุใดเหตุหนึ่งเกิดขึ้น บริษัทสงวนสิทธิ์ที่จะเปลี่ยนแปลงอัตราค่าธรรมเนียมสินเชื่อพิเศษที่ผู้ถือบัตรได้รับให้เป็นอัตราค่าธรรมเนียมสินเชื่อในอัตราสูงสุดที่บริษัทสามารถเรียกเก็บได้ในขณะนั้น จนกว่าแห่งการผิดสัญญาหรือเหตุแห่งการบอกเลิกสัญญานั้นจะได้ถูกแก้ไข โดยไม่ถือเป็นการเปลี่ยนแปลงอัตราดอกเบี้ยและ/หรือค่าธรรมเนียมที่บริษัทต้องแจ้งให้ผู้ถือบัตรทราบล่วงหน้า
4. 2.4 บริษัทมีสิทธิ์ที่จะโอนสิทธิหน้าที่และผลประโยชน์ใด ๆ ตามสัญญาฉบับนี้ไม่ว่าทั้งหมดหรือบางส่วนให้แก่บุคคลอื่นได้ โดยไม่จำเป็นต้องได้รับความยินยอมใด ๆจากผู้ถือบัตร อย่างไรก็ตาม บริษัทจะแจ้งการโอนเป็นลายลักษณ์อักษรผ่านช่องทางต่าง ๆ เช่น ทางเว็บไซต์ แอปพลิเคชัน โปรแกรมออนไลน์ ทางไปรษณีย์ หรือสื่ออิเล็กทรอนิกส์ หรือช่องทางอื่นใดตามที่บริษัทจัดให้มีขึ้น ไปยังผู้ถือบัตร
5. 2.5 บริษัทมีสิทธิ์เปลี่ยนแปลงงวดบัญชีของผู้ถือบัตรโดยจะแจ้งให้ผู้ถือบัตรทราบล่วงหน้าไม่น้อยกว่า 30 วัน และให้ถือว่าหนี้อันเกิดจากการใช้บัตรนั้นถึงกำหนดชำระตามที่ระบุไว้ในใบแจ้งยอดบัญชีโดยไม่ถือเป็นการแปลงหนี้ใหม่
6. 2.6 บริษัทสงวนสิทธิ์ในการเปลี่ยนแปลงข้อกำหนดและเงื่อนไขของการใช้บัตรเครดิต อัตราดอกเบี้ย เบี้ยปรับ ค่าธรรมเนียม ค่าบริการ และค่าใช้จ่ายต่าง ๆ ได้ ไม่ว่าทั้งหมดหรือบางส่วน หรือแก้ไขเปลี่ยนแปลง หรือยกเลิกการให้บริการใด ๆ หรือเพิกถอนสิทธิประโยชน์ของบัตรไม่ว่าทั้งหมดหรือบางส่วน เฉพาะต่อผู้ถือบัตรรายใดรายหนึ่งได้ โดยบริษัทจะแจ้งให้ผู้ถือบัตรทราบล่วงหน้าเป็นลายลักษณ์อักษรผ่านช่องทางต่าง ๆ เช่น ทางเว็บไซต์ แอปพลิเคชัน โปรแกรมออนไลน์ ทางไปรษณีย์ หรือสื่ออิเล็กทรอนิกส์ หรือช่องทางอื่นใดตามที่บริษัทจัดให้มีขึ้น ก่อนจะมีผลบังคับใช้ไม่น้อยกว่าสามสิบ (30) วัน เว้นแต่ในกรณีเร่งด่วน บริษัทจะแจ้งให้ทราบทางจดหมาย หรือจดหมายอิเล็กทรอนิกส์ หรือประกาศทางเว็บไซต์ของบริษัท หรือประกาศทางหนังสือพิมพ์รายวันภาษาไทยล่วงหน้าไม่น้อยกว่าเจ็ด (7) วันก่อนมีผลใช้บังคับ และแจ้งให้ทราบเป็นลายลักษณ์อักษรให้ทราบอีกครั้งหนึ่งตามช่องทางที่ระบุข้างต้น อย่างไรก็ตาม ในกรณีที่การเปลี่ยนแปลงดังกล่าวข้างต้นเป็นประโยชน์หรือลดภาระแก่สมาชิกซึ่งมีผลใช้บังคับได้ทันที บริษัทจะแจ้งให้สมาชิกทราบเป็นลายลักษณ์อักษรภายในสามสิบ (30) วันหลังมีผลใช้บังคับ ทั้งนี้ ให้ถือว่าการเปลี่ยนแปลงดังกล่าวเป็นส่วนหนึ่งของข้อกำหนด และเงื่อนไขฉบับนี้ และผู้ถือบัตรตกลงผูกพันตามข้อกำหนดและเงื่อนไขใหม่ที่ได้แจ้งให้ทราบแล้วโดยไม่ต้องทำเอกสารหลักฐานใด ๆ แก่บริษัทอีกทั้งสิ้น
7. 2.7 การล่าช้าหรืองดเว้นใด ๆ ในการใช้สิทธิ์ของบริษัทตามกฎหมาย หรือตามข้อกำหนดและเงื่อนไขนั้น ไม่ถือว่าบริษัทสละสิทธิ์ หรือให้ความยินยอมในการดำเนินการใด ๆแก่ผู้ถือบัตรแต่ประการใด

3. การชำระหนี้ ดอกเบี้ย ค่าปรับ ค่าบริการ และค่าธรรมเนียมผู้ถือบัตรตกลงให้บริษัทจะเรียกเก็บค่าธรรมเนียมดังต่อไปนี้
1. 3.1 การใช้บัตรเบิกถอนเงินสดล่วงหน้าหรือใช้ชำระค่าสินค้าหรือบริการต่าง ๆ แทนการชำระเงินสดผู้ถือบัตรตกลงที่จะชำระคืนให้แก่บริษัทพร้อมกับค่าธรรมเนียม (ถ้ามี) โดยที่ยอดชำระขั้นต่ำในแต่ละงวดต้องไม่น้อยกว่าอัตราที่บริษัทประกาศใช้ ณ ขณะนั้น
2. 3.2 ในกรณีผู้ถือบัตรไม่สามารถชำระเงินครบถ้วนเต็มจำนวนตามใบแจ้งยอดบัญชีบัตรเครดิตในคราวเดียวกันภายในวันที่ถึงกำหนดชำระถือว่าผู้ถือบัตรขอผ่อนเวลาการชำระหนี้ส่วนที่เหลือโดยตกลงที่จะชำระ ก) ดอกเบี้ยและค่าธรรมเนียมในยอดหนี้ทั้งจำนวนโดยคิดคำนวณจากวันที่มีการบันทึกรายการ/วันที่ได้รับเงินต้น (ตามแต่กรณี) จนถึงวันที่ผู้ถือบัตรชำระหนี้บางส่วน และ ข) ดอกเบี้ยและค่าธรรมเนียมการใช้วงเงินในยอดหนี้ค้างชำระที่เหลืออยู่ ทั้งนี้ สำหรับอัตราดอกเบี้ยและค่าธรรมเนียมนั้นให้เป็นไปตามอัตราที่บริษัทกำหนด ทั้งนี้ ไม่เกินอัตราสูงสุดที่บริษัทจะเรียกเก็บได้ตามที่กฎหมายกำหนดในขณะนั้น โดยบริษัทจะคำนวณดอกเบี้ยและค่าธรรมเนียมดังกล่าว นับจากวันที่บริษัทจ่ายเงินให้ร้านค้าจนถึงวันที่ผู้ถือบัตรชำระหนี้ครบถ้วน (ดอกเบี้ยและค่าธรรมเนียมการใช้วงเงินรวมกันเรียกว่า “ค่าธรรมเนียมสินเชื่อ”)
3. 3.3 กรณีที่ ผู้ถือบัตรทำธุรกรรมใด ๆ ที่เข้าลักษณะการผ่อนชำระเงินต้นที่ใช้จ่ายผ่านบัตร (หรือเบิกถอนผ่านบัตร) เป็นรายงวดตามจำนวนเงินและจำนวนงวดที่ตกลงกับบริษัท ผู้ถือบัตรตกลงและรับทราบว่าจำนวนเงินที่ผู้ถือบัตรต้องชำระแต่ละงวดตามที่บริษัทแจ้งให้ผู้ถือบัตรทราบนั้นเป็นการคำนวณเบื้องต้นโดยใช้อัตราดอกเบี้ย/ค่าธรรมเนียมการใช้วงเงินแบบคงที่เพื่อความสะดวกในการคำนวณหาจำนวนยอดเงินที่ผู้ถือบัตรต้องชำระต่อเดือน ทั้งนี้ เนื่องจากบริษัทใช้หลักเกณฑ์ในการคำนวณค่าธรรมเนียมสินเชื่อแบบลดต้นลดดอก หากผู้ถือบัตรมีการชำระเงินงวดหนึ่งงวดใดน้อยหรือมากกว่าจำนวนที่ระบุข้างต้นและ/หรือมีการชำระไม่ตรงเวลาที่กำหนดจะไม่กระทบจำนวนยอดเงินที่จะชำระในแต่ละงวด (ยกเว้นงวดสุดท้าย) แต่จะมีผลให้จำนวนยอดเงินที่ผู้ถือบัตรต้องชำระในงวดสุดท้ายเพิ่มขึ้นหรือลดลง (ตามแต่กรณี) และ/หรืออาจทำให้จำนวนงวดที่ต้องชำระลดลงหากมีการชำระค่างวดเกินกว่าจำนวนที่กำหนดในแต่ละงวด
4. 3.4 กรณีที่ผู้ถือบัตรชำระหนี้ตามบัตรโดยการใช้เช็ค และปรากฎว่าเช็คดังกล่าวถูกธนาคารปฏิเสธการจ่ายเงิน ผู้ถือบัตรตกลงเสียค่าปรับกรณีเช็คคืนในอัตราที่บริษัทกำหนดแต่ไม่เกินอัตราสูงสุดที่บริษัทจะเรียกเก็บได้ตามกฎหมายที่มีผลใช้บังคับอยู่ในปัจจุบัน
5. 3.5 ผู้ถือบัตรตกลงที่จะชำระค่าธรรมเนียมใด ๆ ที่เกี่ยวข้องกับบัตรตามที่ได้มีการระบุไว้ในใบสมัคร และในตารางค่าธรรมเนียม (หรือที่จะได้มีการแจ้งให้ทราบเพิ่มเติมในภายหน้า) ให้กับบริษัท (ถ้ามี) ทั้งนี้ ค่าธรรมเนียมต่าง ๆ ดังกล่าวจะเป็นไปตามหลักเกณฑ์ที่ธนาคารแห่งประเทศไทยอนุญาต ทั้งนี้ ผู้ถือบัตรรับทราบว่าบริษัทจะทำการเรียกเก็บค่าธรรมเนียมรายปีตามอัตราที่ระบุในตารางค่าธรรมเนียมจากผู้ถือบัตร ในกรณีที่ผู้ถือบัตรไม่มียอดคงค้าง ไม่มีค่าใช้จ่ายผ่านบัญชีของผู้ถือบัตร ไม่มีการเคลื่อนไหวทางบัญชี ไม่ได้มีการติดต่อกับบริษัท และ/หรือบริษัทไม่สามารถติดต่อผู้ถือบัตรได้ (กรณีใดกรณีหนึ่ง) เป็นเวลาติดต่อกันอย่างน้อย 12 เดือน
6. 3.6 นอกเหนือจากค่าธรรมเนียมตามข้อ 3.5 แล้ว ในการใช้บัตรชำระค่าสินค้าและ/หรือบริการรวมถึงการเบิกเงินสดนั้น ในกรณีที่การทำรายการต่าง ๆ ดังกล่าวมีการเรียกเก็บค่าธรรมเนียมหรือค่าใช้จ่ายโดยผู้ประกอบการหรือร้านค้า โดยทำการเรียกเก็บผ่านทางบัญชีบัตร ผู้ถือบัตรตกลงและรับทราบว่าผู้ถือบัตรได้รับทราบถึงค่าธรรมเนียมต่าง ๆ ดังกล่าวแล้ว ณ ขณะทำรายการหรือใช้บัตรและตกลงที่จะชำระค่าธรรมเนียมต่าง ๆ ดังกล่าวที่เกิดขึ้น
7. 3.7 หากมีการติดตามทวงถามหนี้อันเกิดจากการใช้บัตร ผู้ถือบัตรตกลงรับผิดชอบชดใช้ค่าใช้จ่ายที่เกิดขึ้นให้บริษัทเต็มตามจำนวน ซึ่งรวมทั้งค่าใช้จ่ายในการดำเนินคดีตามกฎหมาย ค่าทนายความ และค่าใช้จ่ายอื่น ๆ ที่เกิดขึ้นในการที่บริษัทจะใช้สิทธิ์ตามกฎหมายบังคับให้ผู้ถือบัตรชำระหนี้ตามความในสัญญานี้
8. 3.8 ในกรณีที่บริษัทอนุมัติให้ผู้ถือบัตรเข้าร่วมโครงการปรับปรุงโครงสร้างหนี้ และ/หรือโครงการหรือมาตรการช่วยเหลืออื่นใด ผู้ถือบัตรตกลงว่าเงื่อนไขการชำระหนี้ของผู้ถือบัตรจะเป็นไปตามข้อกำหนดและเงื่อนไขของโครงการปรับปรุงโครงสร้างหนี้ และ/หรือโครงการหรือมาตรการช่วยเหลือที่ผู้ถือบัตรเข้าร่วม

4. ข้อกำหนดและเงื่อนไขการซื้อสินค้า/บริการแบบผ่อนชำระ
เว้นแต่จะตกลงเป็นอย่างอื่น ข้อกำหนดและเงื่อนไขนี้ใช้บังคับกับผู้ถือบัตรที่ซื้อสินค้าและ/หรือชำระค่าบริการแบบผ่อนชำระเป็นงวดๆ ซึ่งถือเป็นส่วนหนึ่งของสัญญานี้
1. 4.1
  ผู้ถือบัตรอาจใช้บัตรซื้อสินค้าและ/หรือใช้บริการจากสถานประกอบการ และ/หรือร้านค้าที่ร่วมรายการ (ซึ่งต่อไปนี้จะเรียกว่า “ร้านค้า”) แบบผ่อนชำระโดยผู้ถือบัตรตกลงที่จะปฏิบัติตามเงื่อนไข ดังต่อไปนี้
  1. 1. สินค้าและ/หรือบริการนั้นจะต้องมีมูลค่าไม่ต่ำกว่าที่บริษัทและ/หรือร้านค้ากำหนด
  2. 2. บริษัทจะเรียกเก็บค่าธรรมเนียมดำเนินการสำหรับสินค้าหรือบริการบางประเภท (ถ้ามี) ค่าธรรมเนียมอื่นใดนอกเหนือจากค่าธรรมเนียมตามที่ระบุในข้อ 3. ซึ่งจะคำนวณระยะเวลาและเงื่อนไขที่ตกลงกัน ซึ่งเมื่อรวมกับค่าสินค้าหรือบริการแล้วจะเป็นยอดเงินทั้งหมดที่ผู้ถือบัตรจะต้องผ่อนชำระ
  3. 3. ผู้ถือบัตรตกลงผ่อนชำระค่าสินค้าและ/หรือบริการเป็นรายงวดตามที่ตกลงกับบริษัทและ/หรือร้านค้า ทั้งนี้ จำนวนงวดการชำระ และ/หรือจำนวนเงินที่ต้องผ่อนชำระในงวดสุดท้ายอาจมีการเปลี่ยนแปลงขึ้นอยู่กับจำนวนเงินและระยะเวลาในการชำระเงินในแต่ละงวดของผู้ถือบัตร
  4. 4. ในการซื้อสินค้าหรือใช้บริการแต่ละคราว ผู้ถือบัตรจะต้องปฏิบัติตามวิธีการใช้บัตรชำระแทนเงินสดของช่องทางการชำระเงินของร้านค้านั้น ซึ่งผู้ถือบัตรต้องลงลายมือชื่อในเอกสารหรือบนอุปกรณ์อื่นใดตามแบบที่บริษัทกำหนด หรือปฏิบัติตามขั้นตอนโดยวิธีอื่นโดยไม่ต้องลงลายมือชื่อในเอกสารหรืออุปกรณ์อื่นใด เพื่อยืนยันการซื้อสินค้า หรือใช้บริการโดยการใช้สินเชื่อตามสัญญาฉบับนี้
  5. 5. ผู้ถือบัตรตกลงให้บริษัทชำระค่าสินค้าและ/หรือบริการให้แก่ผู้ขายสินค้า และ/หรือผู้ให้บริการแทนผู้ถือบัตร และให้ถือว่าผู้ถือบัตรได้รับเงินต้น/สินเชื่อแล้วโดยสมบูรณ์เมื่อผู้ถือบัตรได้รับสินค้าและ/หรือบริการจากผู้ขายสินค้าและ/หรือผู้ให้บริการเรียบร้อยแล้ว หรือเมื่อบริษัทชำระค่าสินค้าให้แก่ผู้ขายสินค้า และ/หรือผู้ให้บริการ (แล้วแต่เหตุการณ์ใดจะเกิดขึ้นก่อน) โดยถือว่าหลักฐานการจ่ายเงินให้แก่ผู้ขายสินค้าและ/หรือผู้ให้บริการเป็นหลักฐานแห่งการใช้เงินสินเชื่อโดยชอบของผู้ถือบัตร
2. 4.2 ผู้ถือบัตรต้องปฏิบัติตามวิธีการใช้บัตรชำระแทนเงินสดตามวิธีการที่กำหนดอยู่ ณ ร้านค้านั้น หรือแสดงบัตรต่อพนักงานของร้านค้าและลงลายมือชื่อในเอกสารการขายหรือการให้บริการ (Sale Slip) หรือบนอุปกรณ์อื่นใด เพื่อเป็นหลักฐานในการใช้บัตรแทนการชำระเงิน เว้นแต่กรณีที่บริษัทหรือร้านค้ากำหนดไว้เป็นการเฉพาะว่าไม่ต้องลงลายมือชื่อในเอกสารการขายหรืออุปกรณ์อื่นใด (แล้วแต่กรณี) ซึ่งไม่ว่าจะเป็นกรณีใดก็ตาม ผู้ถือบัตรยอมรับว่าเป็นการใช้บัตรชำระแทนเงินสดโดยสมบูรณ์แล้ว
3. 4.3 ภายใต้หลักเกณฑ์ในข้อ 3.3 ในกรณีที่ผู้ถือบัตรต้องการชำระค่างวดสินค้าที่ผ่อนชำระในคราวเดียว ผู้ถือบัตรจะต้องติดต่อบริษัทเพื่อสอบถามยอดชำระปิดบัญชีล่วงหน้า และจะต้องชำระเงินที่คงค้างทั้งหมดพร้อมดอกเบี้ย และ/หรือค่าธรรมเนียมการใช้วงเงินสำหรับงวดผ่อนชำระที่เหลือทั้งหมด
4. 4.4 บริษัทไม่รับผิดชอบในความชำรุดบกพร่องของสินค้าหรือบริการใด ๆ ซึ่งผู้ถือบัตรซื้อ ในกรณีที่มีการเปลี่ยนหรือคืนสินค้า ผู้ถือบัตรตกลงที่จะปฏิบัติตามระเบียบและหรือข้อกำหนดในการเปลี่ยนหรือคืนสินค้าของร้านค้าหรือสถานประกอบการนั้น ๆ
5. 4.5 ผู้ถือบัตรอาจทำรายการผ่อนชำระค่าสินค้า และ/หรือบริการผ่านทางโทรศัพท์ และ/หรือผ่านเว็บไซต์ และ/หรือแอปพลิเคชัน และ/หรือผ่านทางโปรแกรมออนไลน์ที่จัดให้มีโดยบริษัทบนโทรศัพท์เคลื่อนที่หรืออุปกรณ์ใด ๆ และ/หรือช่องทางอื่น ๆ ที่บริษัทแจ้งให้ทราบได้ตามข้อกำหนดและเงื่อนไขของบริษัท ทั้งนี้ เว้นแต่ข้อกำหนดและเงื่อนไขในเรื่องดังกล่าวจะกำหนดไว้เป็นอย่างอื่นผู้ถือบัตรตกลงว่าให้นำข้อกำหนดตามข้อ 4 ข้อ 5 และข้อ 7 ของสัญญานี้มาใช้บังคับโดยอนุโลม

5. ข้อกำหนดและเงื่อนไขการใช้บริการและธุรกรรมทางโทรศัพท์
1. 5.1 ผู้ถือบัตรสามารถใช้รหัสประจำตัวของผู้ถือบัตร ซึ่งใช้กับบัตรตามที่ผู้ถือบัตรกำหนดด้วยตนเองตามวิธิการที่บริษัทกำหนด หรือที่บริษัทจัดส่งให้กับผู้ถือบัตรตามที่ผู้ถือบัตรร้องขอ หรือที่ผู้ถือบัตรลงทะเบียนได้มา หรือด้วยวิธีการทางอิเล็กทรอนิกส์ใด ๆ ตามกฎหมายว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ หรือที่จะได้มีการเปลี่ยนแปลงในภายหน้าในการใช้บริการอัตโนมัติทางโทรศัพท์หรือช่องทางอื่นใดของบริษัท ทั้งนี้ ผู้ถือบัตรสัญญาว่าจะรักษารหัสดังกล่าวไว้เป็นความลับแต่เพียงผู้เดียวเท่านั้น หากผู้ถือบัตรประสงค์จะเปลี่ยนรหัสดังกล่าวก็สามารถทำได้โดยไม่จำเป็นต้องแจ้งให้บริษัททราบ
2. 5.2 ผู้ถือบัตรตกลงยินยอมรับผิดชอบในการกระทำใด ๆ ที่ดำเนินการผ่านบริการอัตโนมัติทางโทรศัพท์โดยใช้รหัสประจำตัวของผู้ถือบัตร และ/หรือที่ได้ทำผ่านโทรศัพท์โดยการติดต่อกับเจ้าหน้าที่ของบริษัท (ซึ่งจะได้มีการตรวจสอบยืนยันข้อมูลส่วนตัวของผู้ถือบัตร) และ/หรือช่องทางอื่นใดที่บริษัทกำหนดหรือจัดทำขึ้น รวมถึงแต่ไม่จำกัดเพียงการขอเบิกใช้เงินสดล่วงหน้า หรือการเปลี่ยนแปลงข้อมูลส่วนบุคคล โดยให้ถือว่าเมื่อได้ทำธุรกรรมหรือคำร้องขอใด ๆ แล้วให้มีผลผูกพันผู้ถือบัตรโดยไม่อาจเพิกถอนได้ เว้นแต่จะทำเป็นหนังสือยืนยันการเพิกถอนธุรกรรมนั้น ๆ และให้ผลแห่งการกระทำใด ๆ ที่กระทำผ่านทางโทรศัพท์มีผลผูกพันทั้งผู้ถือบัตรหลักและบัตรเสริมทุกประการ
3. 5.3 ผู้ถือบัตรตกลงยอมรับว่าบรรดาคู่มือวิธีการใช้บริการอัตโนมัติทางโทรศัพท์ เอกสารต่าง ๆ ที่เกี่ยวข้องกับบริการดังกล่าว ทั้งที่มีอยู่แล้วในขณะนี้ หรือที่จะมีต่อไป (หรือแก้ไข) ในภายหน้าซึ่งบริษัทได้มอบหรือจัดส่งให้แก่ผู้ถือบัตร รวมทั้งคำสั่ง คำแนะนำ คำตอบรับ หรือธุรกรรมใด ๆ ทางเครื่องโทรศัพท์ซึ่งผู้ถือบัตรใช้ในการดำเนินการต่าง ๆ นั้นถือเป็นส่วนหนึ่งของข้อกำหนดและเงื่อนไขตามสัญญานี้ด้วย
4. 5.4 ผู้ถือบัตรตกลงชำระค่าธรรมเนียมการใช้บริการอัตโนมัติทางโทรศัพท์หรือช่องทางอื่นใด (ถ้ามี) ตามกำหนดเวลาและอัตราที่บริษัทกำหนด โดยบริษัทสงวนสิทธิ์ที่จะเปลี่ยนแปลงค่าธรรมเนียมการใช้บริการอัตโนมัติทางโทรศัพท์ หรือช่องทางอื่นใด ตามอัตราที่บริษัทกำหนดเมื่อใดก็ได้ โดยบริษัทจะดำเนินการแจ้งให้ผู้ถือบัตรทราบเป็นลายลักษณ์อักษรล่วงหน้าอย่างน้อย 30 วัน
5. 5.5 ผู้ถือบัตรรับทราบว่าในการทำธุรกรรมใด ๆ ผ่านทางโทรศัพท์ (รวมถึงการติดต่อใด ๆ กับบริษัทผ่านทางโทรศัพท์) หรือช่องทางอื่นใด นั้นอาจมีการบันทึกเสียงหรือบันทึกข้อมูลในระบบคอมพิวเตอร์เพื่อใช้ในการตรวจสอบหรือใช้เป็นหลักฐาน โดยผู้ถือบัตรตกลงให้บริษัทสามารถบันทึกเสียงและข้อมูลดังกล่าวได้ และสามารถให้ใช้บันทึกดังกล่าวเป็นหลักฐานอ้างอิงในการทำธุรกรรมใด ๆ ระหว่างบริษัทกับผู้ถือบัตร

6. ข้อกำหนดและเงื่อนไขการใช้บัตรกับเครื่องฝาก -ถอนเงินอัตโนมัติ (ATM)
1. 6.1 ผู้ถือบัตรสามารถนำบัตรไปใช้บริการต่าง ๆ ผ่านเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) ของธนาคารพาณิชย์ ทั้งในและต่างประเทศตามแต่คุณสมบัติของแต่ละประเภทบัตรที่บริษัทกำหนด ผู้ถือบัตรต้องใช้รหัสประจำตัว (PIN) ที่ผู้ถือบัตรกำหนดด้วยตนเองตามวิธิการที่บริษัทกำหนด หรือที่บริษัทจัดส่งให้กับผู้ถือบัตรตามที่ผู้ถือบัตรร้องขอ หรือที่ผู้ถือบัตรลงทะเบียนได้มา หรือด้วยวิธีการทางอิเล็กทรอนิกส์ใด ๆ ตามกฎหมายว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ ประกอบการใช้บัตรผ่านเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) ทุกครั้ง ทั้งนี้ ผู้ถือบัตรสัญญาว่าจะรักษารหัสดังกล่าวไว้เป็นความลับแต่เพียงผู้เดียวเท่านั้น หากผู้ถือบัตรประสงค์จะเปลี่ยนรหัสดังกล่าวก็สามารถทำได้โดยไม่จำเป็นต้องแจ้งให้บริษัททราบ
2. 6.2 ผู้ถือบัตรจะใช้บัตรทำรายการต่าง ๆ ได้ไม่เกินจำนวนครั้ง และจำนวนเงินที่บริษัทกำหนด และกรณีการใช้บริการผ่านเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) หากผู้ถือบัตรกดรหัสผิดเกินกว่าจำนวนที่ผู้ให้บริการเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) แต่ละรายกำหนด ผู้ถือบัตรจะไม่สามารถทำรายการใด ๆ ผ่านบัตรได้อีก จนกว่าผู้ถือบัตรติดต่อกับบริษัท
3. 6.3 ในการใช้บัตรเพื่อเบิกเงินสด ผู้ถือบัตรตกลงยอมผูกพันตามข้อกำหนดและเงื่อนไขต่าง ๆ ตามสัญญานี้ และให้ถือว่า (1) ใบบันทึกรายการดังกล่าว และ/หรือ (2) ข้อมูลที่บริษัทได้รับจากระบบคอมพิวเตอร์ของธนาคารเจ้าของเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) เป็นหลักฐานการได้รับเงินของผู้ถือบัตรตามสัญญาฉบับนี้แล้ว
4. 6.4 ในการทำธุรกรรมผ่านเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) อาจจะมีการเรียกเก็บค่าธรรมเนียมการใช้บริการโดยสถาบันการเงินผู้ให้บริการเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) ซึ่งไม่เกี่ยวข้องกับบริษัท ดังนั้น ผู้ถือบัตรควรศึกษารายละเอียดค่าธรรมเนียมดังกล่าวก่อนทำรายการโดยบริษัทจะถือว่าในการทำรายการของผู้ถือบัตรนั้น ผู้ถือบัตรตกลงและรับทราบในค่าธรรมเนียมดังกล่าวและผู้ถือบัตรตกลงยินยอมชำระค่าธรรมเนียม และค่าใช้จ่ายใด ๆ ที่เกี่ยวกับการใช้บริการผ่านเครื่องฝาก-ถอนเงินอัตโนมัติ (ATM) และตกลงยินยอมให้บริษัทหักเงินจากบัตรเครดิตของผู้ถือบัตรได้ตามอัตราและกำหนดเวลาที่บริษัทกำหนด

7. ข้อกำหนดและเงื่อนไขการทำธุรกรรมและ/หรือการใช้บริการผ่านทางเว็บไซต์ของบริษัท หรือแอปพลิเคชัน หรือผ่านทางโปรแกรมออนไลน์ที่จัดให้มีโดยบริษัทบนโทรศัพท์เคลื่อนที่ หรืออุปกรณ์ใด ๆ
1. 7.1 ผู้ถือบัตรสามารถใช้บริการบางประเภทผ่านทางเว็บไซต์ หรือโปรแกรมของบริษัท หรือแอปพลิเคชัน หรือผ่านทางโปรแกรมออนไลน์ที่จัดให้มีโดยบริษัทบนโทรศัพท์เคลื่อนที่หรืออุปกรณ์ใด ๆ หรือช่องทางอื่นใดที่บริษัทจัดทำขึ้น (ตามที่มีให้บริการอยู่ ณ ขณะใดขณะหนึ่ง) ได้โดยทำการลงทะเบียนผ่านทางเว็บไซต์ หรือแอปพลิเคชัน หรือโปรแกรมของบริษัท หรือช่องทางอื่นใดที่บริษัทจัดทำขึ้น โดยผู้ถือบัตรจะต้องใช้รหัสประจำตัวที่ได้รับจากการลงทะเบียน (หรือที่ผู้ถือบัตรเป็นผู้กำหนดด้วยตนเองตามวิธีการที่บริษัทกำหนด) ในการทำธุรกรรมหรือใช้บริการต่าง ๆ ผ่านทางเว็บไซต์ และ/หรือแอปพลิเคชัน และ/หรือบนโปรแกรม และ/หรือช่องทางอื่นใดที่บริษัทจัดทำขึ้นดังกล่าว
2. 7.2 ผู้ถือบัตรรับทราบว่าในการทำธุรกรรมและ/หรือใช้บริการใด ๆ ผ่านทางเว็บไซต์ของบริษัท และ/หรือแอปพลิเคชัน และ/หรือบนโปรแกรม และ/หรือช่องทางอื่นใดที่บริษัทจัดทำขึ้น ผู้ถือบัตรตกลงยอมรับและจะปฏิบัติตามข้อกำหนดและเงื่อนไขต่าง ๆ ที่เกี่ยวกับการใช้เว็บไซต์ของบริษัท และ/หรือแอปพลิเคชัน และ/หรือบนโปรแกรม และ/หรือช่องทางอื่นใดที่บริษัทจัดทำขึ้นดังกล่าวทุกประการ และให้ถือว่าการกระทำดังกล่าวมีผลผูกพันผู้ถือบัตรตามสัญญาฉบับนี้แล้วโดยไม่จำต้องทำเป็นเอกสารลงลายมือชื่อของผู้ถือบัตรอีก
3. 7.3 ผู้ถือบัตรรับทราบว่าในการทำธุรกรรมและ/หรือใช้บริการใด ๆผ่านทางเว็บไซต์ของบริษัท และ/หรือแอปพลิเคชัน และ/หรือบนโปรแกรมและ/หรือช่องทางอื่นใดที่บริษัทจัดทำขึ้นนั้น อาจมีการบันทึกข้อมูลการทำธุรกรรมดังกล่าวเพื่อใช้ในการตรวจสอบและสามารถให้ใช้บันทึกดังกล่าวเป็นหลักฐานอ้างอิงในการทำธุรกรรมใด ๆ ระหว่างบริษัทกับผู้ถือบัตรโดยไม่จำต้องได้รับความยินยอมจากผู้ถือบัตรอีก

8. ข้อกำหนดและเงื่อนไขเกี่ยวกับคะแนนสะสมและการแลกของรางวัล
1. 8.1 ผู้ถือบัตรตกลงและรับทราบว่าบริษัทอาจจัดให้มีรายการคะแนนสะสม หรือรายการผลประโยชน์เป็นครั้งคราวอันเนื่องมาจากการใช้บัตรของผู้ถือบัตร ตามข้อกำหนดและเงื่อนไขของรายการนั้น ๆ ตามที่บริษัทจะได้แจ้งให้ผู้ถือบัตรทราบ ทั้งนี้ ผู้ถือบัตรตกลงผูกพันตามข้อกำหนดต่าง ๆ ดังกล่าวที่เกี่ยวข้องและให้ถือว่าเป็นส่วนหนึ่งของสัญญาฉบับนี้
2. 8.2 ผู้ถือบัตรตกลงว่าบรรดาสิทธิประโยชน์และ/หรือสิทธิพิเศษใด ๆ รวมถึงแต่ไม่จำกัดเพียงสิทธิพิเศษจากรายการส่งเสริมการขาย รายการคะแนนสะสม หรือสิทธิประโยชน์อื่น ๆ ที่บริษัทจะจัดให้กับผู้ถือบัตรนั้น นอกเหนือจากที่ได้มีการระบุไว้ในเงื่อนไขของรายการนั้น ๆ ผู้ถือบัตรตกลงว่าบริษัทมีสิทธิ์ที่จะมอบสิทธิประโยชน์และ/หรือสิทธิพิเศษต่าง ๆ ดังกล่าวให้แก่ผู้ถือบัตรที่ปฏิบัติถูกต้องตามเงื่อนไข (หากมี) เว้นแต่กรณีที่บัญชีของผู้ถือบัตรถูกระงับหรือยกเลิก (ไม่ว่าชั่วคราวหรือถาวร) หรือผู้ถือบัตรมีประวัติการชำระเงินไม่ดี หรือมีการใช้บัตรเพื่อการพาณิชย์หรือเพื่อการใด ๆ อันผิดวัตถุประสงค์การใช้บัตรเครดิต ผิดกฎหมายหรือขัดต่อศีลธรรมอันดีของประชาชน หรือมีการชำระเงินเข้าบัญชีบัตรเกินกว่ายอดที่ต้องชำระโดยมีเจตนาที่จะรับสิทธิประโยชน์และ/หรือสิทธิพิเศษซึ่งมากกว่าที่ควรได้รับจากการใช้บัตรภายในวงเงินที่บริษัทอนุมัติ หรือกรณีที่ผู้ถือบัตรกระทำผิดข้อกำหนดและเงื่อนไขใด ๆ ตามสัญญานี้

สัญญาฉบับนี้อยู่ภายใต้บังคับและตีความตามกฎหมายของประเทศไทย ในกรณีที่มีการจัดทำขึ้นทั้งฉบับภาษาไทยและฉบับภาษาอังกฤษ หากมีข้อความขัดแย้งกัน ให้ใช้สัญญาฉบับภาษาไทยเป็นหลักในการบังคับใช้และตีความ

For cardholders who hold Current or Savings account at Bank of Ayudhya, simply ask for Direct Debit application.
To enroll, please complete direct debit application form and send to Bank of Ayudhya Public Company Limited at your branch account.
When the payment due date arrives, the company will automatically deduct the amount from the bank account (please deposit money into your bank account 1 day in advance to ensure sufficient fund).
Payment with direct debit facility, the cardholders will receive the billing statement in advance like other payment methods.

Transfer Payment via www.krungsrionline.com and Krungsri Mobile Application (KMA)

Krungsri Online Service enables 24-hour flexibility to pay your bills online with credit card payment. This helps the cardholder to pay bill anytime 24 hours a day 7 days a week.

Steps in applying for Krungsri Online

To apply the service, applicant must have either current or saving accounts registered at Bank of Ayudhya at any branch
Complete the application form provided on the Krungsri Online homepage. Choose your own User ID and Password to access Krungsri Online. The application form is also available at all BAY’s branches,
Verify your personal data, and print and sign the application form along with the terms and conditions on the application form. The signature must be similar to the signature given when opening the account.
Mail the application form along with a signed photocopy of your identification document to the branch hosting your account within 30 days from the applied date.
The bank will send a notice of access to Krungsri Online Service via postal mail within 7 business days (for applications sent to the account hosting branch). 7-14 business days processing time is required for applications submitted to non-account hosting branches.

Pay via mobile phone by True Money or mPAY

The payment is limited to 30,000 Baht/transaction. Service fee is 10 Baht/transaction nationwide. (True Move customers call 1331 # 6) (AIS customers call 1175)

Bank Counter Pay
The cardholder can make payment by cash or cheque, using payment form with barcode (form attached with billing statement). The cheque should be crossed and made payable to Bank of Ayudhya. Please indicate your name, surname, and credit card account on the reverse side of your cheque.

Krungsriayudhaya Card Company Limited will withhold/suspend the benefits or recall the benefits (including the accumulated Krungsri points), or charge back to the cardholder's credit card account according to the value of the benefits received by the cardholder in the event that the benefits have been granted in error, the cardholder cancels/rejects transactions or payments subsequently (in full or partial amount), the spending exceeds the credit limit due to overpay or temporary credit limit, benefits are obtained through dishonest or fraudulent means, or the credit card is used for commercial purposes /or for purchasing goods/services from merchants in which the cardholders have direct and indirect interests /or using the credit card for the wrong purpose of purchasing goods/services purposes or not in accordance with the credit card agreement or personal loan agreement (as the case may be), or transactions related to Digital Assets or Cryptocurrency.

Emergency Roadside Assistance & Towing services are available nationwide including Phuket but do not cover islands.
Emergency Roadside Assistance & Towing services shall not be included for road accidents.
The Company reserves the right to be responsible for towing expenses at THB 1,500 per time, or equivalent to the first 20 kilometers and only 1 time limit per calendar year. The additional service fees that are beyond these terms and conditions as specified by the company, the card members must pay such additional service fees on their own.
The Company reserves the right to be responsible for Emergency Roadside Assistance & Towing services expenses only when the primary card holders are at the car while Emergency Roadside Assistance & Towing services have been servicing to the card members and these services cannot transfer, change or compensate to others.
The Company reserves the right to be responsible for the payment of Emergency Roadside Assistance & Towing services in case of emergency breakdown issues only such as flat tire, engine disabled, overheating engine battery failed and etc.
In case of car spare parts changing, the card members must be responsible for the expense.
